Chairperson introduced the following resolution and moved for its adoption: RESOLUTION #03-09- A RESOLUTION DENYING 'THE ISSUANCE OF A VARIANCE TO Bt;L~DLEY SPLEISS AT 16021 JASPzkR ST NW (PERMITTEE) FOR SIDE YARD SETBACK REQUIREMENTS FOR A CORNER LOT AND DECLARING TERi~[S OF SAME WHEREAS, Bradley Spleiss (Permit-tee) has properly applied for a variance from Section 9.20.11 of the Ramsey City Code to construct an accesso~ structure which would infringe on the side yard setback requirement for an accessory, structure on the property, generally known as 16021 Jaspar St NW and Iegaily described as follows: Commencing at the northeast corner of the Southwest Quarter of Section 15, Township 32, Range 25, Anoka County,, Minnesota; thence on a bearing of south 89 degrees. 29 minutes west a distance of 870.03 feet; thence on a beating of south parallel with the east line of said Southwest Quarter a distance of 253.00 feet to the point of beginning of the tract of land to be described; thence continue on a bearing of south a distance of 263.00 feet: thence on a bearing of east a distance of 209.76 i'eet; thence on a bearing of north a distance of 263.00 feet; thence on a bearing of west a distance of 279.76 feet to the point of beginning. Along and together with the right to ingress and egress over the following described easements. A strip of land 33 feet in width lying east of and directly adjacent to the following described line: Commencing at the northeast corner of said Southwest Quarter; thence on a bearing of south 89 degrees, 29 minutes west along the .north line thereof a distance of 8,0.0,~ t'eet to the point of be_ginning of the line to be described; thence on a bearing of south parallel to the east line of said Southwest Quarter to Anoka County, Road No. 56 and there terminating. Said adjacent line to be extended north to ks intersection with said north line thereo£ ,~md also over a strip of land 66 feet in width lying 33 feet on each side of the following described centeriine: Commencing at the northeast corner of said Southwest Quarter, thence on a bearing of south 89 degrees 29 minutes west along the north line thereof a distance of 870.03 feet; thence on a bearing of south parallel to the east line of said Southwest Quarter a distance of 253.00 feet to the point of beginning of the centerline to be described; thence on a bearing of east a distance of 419.53 feet to a point on a line parallel with and 450.46 feet west (as measured at right angles) of the east line of said Southwest Quarter; thence continue on a bearing of east a distance of 33 feet; thence return on a bearing of west along last described course 33 feet to said parallel line; thence on a bearing of south a distance of 789.0 feet; the~nce return on a bearing of north along last described caurse a distance of 33 feet; thence on a bearing of west a distance of 419.53 feet to its intersection with a line bearing south from the point of beginning and there terminating.
