CASE # I~ <br /> REQUEST FOR A VARIz~NCE TO BUILDING HEIGHT <br /> IN THE ALPINE MEADOWS SUBDIVISON; <br /> CASE OF SHADETREE CONSTRUCTION, INC. <br />By: Patrick Trudgeon, AICP, Assistant Community Development Director <br /> <br />Background: <br /> <br />Shadetree Construction Inc. [s building the townhome units contained in' the Alpine Meadows <br />subdivision. In mid-August, City Staff noticed that a taller and di~%rent style of units were going <br />up than were approved in 2002 and halted construction. The units were still contained within the' <br />same tots lines approved as part of the Alpine Meadows plat, but a third story was added and the <br />exterior elevations had changed. The units that were approved in 2002 had a height of 35 fee~ as <br />measured to the peak of the rook. The unit being constructed currently is 40.5 feet to the peak of <br />the root: Staff' informed Shadetree that a variance would be necessary, to construct the unit to that <br />height. <br /> <br />Notification: <br /> <br />In accordance with State Statute, owners of property within 350 feet of the subject property were <br />notified of the request for variance. <br /> <br />Observations: <br /> <br />In the time since the public heari.ng was legally noticed in the newspaper, Staff has deten2ined <br />that due to the changes on how height is measured under the new residential codes, the unit under <br />construction meets the City's height requirement. The new code measures height from the mean <br />ground elevation to the mean gable height, and not to the peak, as was previously the case. The <br />mean gable height tbr this unit is 34 feet. There~bre, a variance is not temhz~ically needed since <br />the unit meets City Code. However, it should be pointed out that the unit has changed from the <br />site plan approved [n 2002 and a revision to the site plan is needed. Staff' has drafted a case for <br />the Ptanning Commission agenda to consider the revision to sire plan. <br /> <br />Since it is Staff's determination that a variance is not needed, the Planning Commission should <br />open and close the public hearing regarding the height variance. No action is required, <br /> <br />Recommendation: <br /> <br />City Staff recommends the Board open and close the public hearing and note for the record that <br />after further review of the case, no variance is needed to the height regulations of City.
