CASE # <br /> <br /> PUB L I C tarEARIIY G <br />REQUEST FOR A VARIANCE T'O THE SIDE YARD SETBACK FOR AN <br />ACCESSORY STRUCURE; <br /> CASE OF BRADLEY SPLEISS <br /> By: Chris Anderson, Community Development Assistant <br /> <br />Background: <br /> <br />Thd City has received an application tbr a variance to Section 9.20.11 (R-1 Residential District) <br />of the Ramsev City Code. On properties located outside the 2020 NFUSA area, the side yard <br />setback for ali accessory structure is ten (10) feet. The Applicant is proposing to construct an <br />accessory structure six and a hall' (6.5) feet l}om the side property line in an effort to preserve <br />mature oak trees on the property. <br /> <br />The following items are enclosed for your in-formation: <br /> <br />a) Site location map <br />b) Site layout <br />c) Site picture <br />d) Letter f.~om the Applicant <br />e) Proposed Findings of Fact <br /> Proposed resolution to approve variance <br />g) Proposed resolution to deny variance <br /> <br />Notificatio n: <br /> <br />State stature requires notification of the public hearing to property owners witl~in 350 feet of the <br />subject property. Staff sent out notices to all propexy owners within 350 feet. <br /> <br />Observations: <br /> <br />City Code requires a ten ([0) foot side yard setback ~br p~-operties zoned R-I Rural Developing. <br />The Applicant would iike to construct the structure six and a half (6.5) feet I¥om the property line <br />to eliminate the need to remove two mature oak trees as well as to still provide dr/ye through <br />access with a vehicle and trailer. The subject property, has mature oak trees scattered throughout <br />it and a majority of the western side of the property contains the septic system and the attemate <br />site in case of failure. <br /> <br />Recommendation: <br /> <br />Staff is' recommending approval of the variance to the side yard setback. <br /> <br /> <br />
