CASE <br /> <br />REQUEST FOR A CONDITIONAL; USE PERMIT FOR A2N OVERSIZED ACCESSORY <br />BUILDING; <br /> CASE OF SHIRLEY WILSON <br /> By: Chris Anderson, Community Development Assistant <br /> <br />Background: <br /> <br />The City received an application from Shirley Wilson for a conditional use permit to exceed the <br />accessory building size restrictions established in City, Code on the property located at-5391 156°a <br />Lane NW. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Proposed Site Plan <br />c) Picture of proposed site <br />d) Proposed findings of fact <br />e) Proposed conditional use permit <br />~) Proposed resolution denying conditional use permit <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to property owners within 350 feet of the <br />subject property. Staff sent out notices to all property owners within 350 feet. <br /> <br />Observations: <br /> <br />The subject property is approximately 0.84 acres (36,750 square feet) in size and is located inside <br />the Metropolitan Urban Service Area (MUSA). Under City Code, parcels between 14,880 sq. ft. <br />and 43,559 sq. ft. can have up to 1,488 square feet of accessory building space. The proposed <br />building will be 1,200 square feet-(30' x 40') in size. Coupled with the existing garage (528 sq. <br />ft.), the applicant will have 1,728 sq. ft. in accessory buildings. This results in an overage of 240 <br />square feet. The applicant would like to exceed the 1,488 square feet restriction in order to <br />construct a detached accessory building that would accommodate the storage of private use <br />vehicles and equipment. <br /> <br />The proposed detached accessory building will be located in the rear yard. The proposed <br />accessory building location will meet and/or exceed all setbacks established in the R-1 MUSA <br />District Bulk Standards. City. Code does restrict properties within the MUSA to one driveway <br />and the applicant is aware that a second driveway is prohibited. <br /> <br />Recommendation: <br /> <br />Staff is recommending approval of Shirley Wilson's request~ for a conditional use permit to <br />exceed the accessory building size restriction established in City Code. <br /> <br />13 <br /> <br /> <br />
