does not comain a principal dwelling. Mr. Menard now desires to sell the lO-acre parcel and
accessory structure. Due to the large size and construction type of the accessory structure, Mr.
Menard is finding that commercial users are mainly interested in purchasing the land and
accesso~ structure. '~

Mfr. Menard is in a situation where his property is zoned residential and City Code does not
include any provisions fbr the City to consider business operations within an accessory structure
in the residential district. City Code currently allows a Home Occupation to be obtained for
operations that take place completely within the principal dwelling. Pk. Mfenard requested the
City look at rewriting the current Home Occupation Ordinance to allow the City the opportunity
to accept Home Occupation applications to operate a business within an accesso~ structure.

The enclosed Home Occupation Ordinance will allow potential buyers of Mk. Menard's facility
to apply for a Home Occupation Permit to operate their business within Mir. Menard's accessory
structure. A list of businesses is included in the ordinance ro allow Mir. Menard some guidance as
to what types of businesses the City will "consider" when reviewing a Home Occupation Permit
application. Recommending approval of the enclosed ordinance will now provide a means for
Mr. Menard to sell his property To a commercial user that successfully obtains Home Occupation
Permit from the City.

Planning Commission Action:

The Planning Commission should make desired revisions and recommend the City Council
approve the enclosed Home Occupation Ordinance.

PC: 9.4.03

3O
