CASE # <br />ADOPT ORDINANCE AMENDING ORDINANCE NO. 04-33 TO PROVIDE FOR <br />REIMBURSEMENT FOR THE PURCHASE OF A COMPUTER <br />By: Kurt Ulrich, City Administrator <br />Background: <br />At the October 12, 2010 meeting, Council introduced an ordinance to provide for reimbursement <br />to members of the City Council for the purchase of a computer for use in their official capacity <br />as Ramsey City Councilmembers. The maximum amount of reimbursement would be $800 with <br />receipt for proof of purchase of said computer and the purchase had to be completed within the <br />first six months of their term. The proposed ordinance, presented on October 12, was amended <br />to include Mayor -Elect and Council -Elect who take office effective January 1 of any year to be <br />reimbursed after January 1 of any year, for their computer equipment purchased prior to the <br />effective date of the commencement of their term in office. Language was also added stating <br />any Mayor or Councilmember in office at the time of the effective date of this ordinance may <br />receive said reimbursement within six (6) months of the effective date. Staff feels this amended <br />verbiage was the intent of the original proposed ordinance and therefore, the ordinance does not <br />have to be brought back for re- introduction. <br />As was stated in the Consent case language of October 12, the intent of this provision is that the <br />equipment would be owned by the Councilmember, it would be taxable, and considered a salary <br />compensation increase. Council compensation increases are done by ordinance; therefore, this <br />would amend the ordinance authorizing the last Council salary increase. The annual salary will <br />remain the same but the reimbursement for computers would be added as a benefit. Under the <br />proposal, the Councilmember may refuse the benefit and simply borrow a computer from the <br />City for City Council use, as is the current practice. <br />Staff Recommendation: <br />Staff is recommending Council note the suggested language amendments and adopt the attached <br />ordinance. <br />Council Action: <br />Motion to adopt Ordinance #10 -XX amending Ordinance No. 04 -33 to provide for <br />reimbursement for the purchase of a computer, effective January 1, 2011. <br />Reviewed by: <br />City Clerk <br />City Attorney <br />City Administrator: <br />CC: 10/26/10 <br />
