CONSIDER ORDERING IMPROVEMENT PROJECT #10 -25, THE BITUMINOUS <br />PAVING OF CHAMELEON STREET IN THE SHAWN ACRES SUBDIVISION <br />By: Steven J Jankowski, Assistant City Engineer <br />Background: <br />A public hearing was held on the above improvement project on August 24, 2010. This project <br />was initiated through a citizen petition and the thirty day counter - petition period under City <br />Charter has expired without the City receiving such petition opposing this project. <br />At the public hearing one property owner having two benefitted lots, Lots 8 and 9 of Block 1 <br />SHAWN ACRES, indicated that they had combined their two lots into one PIN number and <br />requested a single assessment for their property. Council was advised by the City Attorney that <br />this request could be considered at a later point in the process; the assessment hearing following <br />completion of the project. Staff suggests that it may be desirable to address this issue prior to the <br />construction of this project for accounting purposes. <br />Staff has reviewed past practices associated with similar projects and has determined that <br />assessments for multiple lots have been levied on the same property owner. However in those <br />cases separate PIN numbers existed for each assessed property. <br />It is anticipated that contracts could be awarded the summer of 2011, with construction to <br />commence thereafter. Final costs will be presented at the assessment hearing in September of <br />2011. <br />Financial Impact: <br />The total cost of the project is estimated to be $323,998 and is anticipated to be financed as <br />follows: <br />• $150,119 City General Fund <br />• $37,724 Storm Water Utility <br />• $136,145 Property Assessments (does not include Shawn Acres Park — City cost) <br />Recommendation: <br />Staff recommends reducing the assessment for Lots 8 and 9 of Block 1 SHAWN ACRES, now <br />combined into one property /PIN, to a single share with the City contributing the difference in <br />order to maintain the assessment for the other benefited properties at the level identified in the <br />feasibility study. This will result in an additional $6,982 in City costs over the funding identified <br />above. <br />Council Action: <br />Motion to adopt resolution 10- 10 -XXX ordering Improvement Project 10 -25 by directing the <br />preparation of plans and specifications for this project, and to modify the assessment role by <br />assessing one share per property PIN. <br />CASE # 9.03 <br />
