-36-

Community Development Director Frolik replied that the issue of strip clubs is addressed under
adult uses in City Code.

Councilmember Hendriksen stated that there needs to be something to protect the City fi.om
having something undesirable fi.om happening. He explained that within any zoning district
there are a number of permitted uses and the Council may choose to rezone the property with a
vision of one or two of those permitted uses, but then all of a sudden after the property is rezoned
the land is developed into something else.

Councilmember Kurak inquired as to how they prevent that fi.om happening.

Councilmember Hendriksen suggested having staff review other city ordinances.

Councilmember Zimmerman inquired if Sunfish Ponds was done under a planned unit
development.

Community, Development Director Frolik replied no.

Councilmember Zimmerman stated that when that plan was presented to the Council it indicated
single family homes and townhomes. Everything was laid out before the development occurred
and there was very little distention over the development because the property owners knew what
was going to occur before it happened.

Community Development Director Frolik reviewed the Andover ordinance noting that their
procedures are similar to what the City of Rarnsey does. She suggested streng~&ening what they
do by stating that action on the rezoning will not be done until a final plan is submitted and if the
development does not occur within one year the Council could change the zoning back to its
original zoning. That language would put the developer on notice that the Council could change
the zoning back to its original zoning if they do not act in a timely manner.

Councilmember Zimmerman inquired if a developer requested a rezoning from single family to
multiple family without a development plan could the City refuse the application.

Community Development Director Frolik replied yes, because the developer would need to
present a general development plan. She also noted that the Council has the discretion to
determine if a property is appropriate for zoning.

Councilmember Anderson inquired if the City Attorney had reviewed Andover's policy.

City Administrator Norman replied that he had not reviewed it in geat detail.

Community Development Director Frolik noted that the Council currently has the authority to
revert a zoning back to its original zoning.

City Council/May 6, 2002
