Board Member introduced the following resolution and moved for its adoption: <br />RESOLUTION # <br />RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A <br />REQUEST FROM DALE AND SHARON GRUNDBERG FOR A VARIANCE TO <br />ALLOW FOR THE EXISTING PORCH TO ENCROACH TEN FEET INTO THE REAR <br />YARD SETBACK ON THE PROPERTY LOCATED AT 5971 143RD CIRCLE. <br />WHEREAS, Dale and Sharon Grundberg, hereinafter referred to as "Applicants," have <br />properly applied for a Board of Adjustment variance from Section 117-111 of the Ramsey City <br />Code to allow for the existing porch to encroach ten feet into the rear yard setback and to enclose <br />the porch to create a three season porch on the property located at 5971 143`d Circle and legally <br />described as follows: <br />Lot 7, Block 1, Chestnut Hill, Anoka County, Minnesota <br />("Subject Property"). <br />NOW THEREFORE, BE. IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />That the Applicant appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 117-53 of the Ramsey City Code on November 4 2010, and that said public <br />hearing was properly advertised, and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br />2. That the Subject Property is zoned R-1 Single Family Residential MUSA and is located <br />within the Shoreland Overlay District. <br />3. That the Subject Property is surrounded by R-1 Single Family Residential MUSA zoning to <br />the north, south, and east. To the west, the property is bounded by land designated <br />Public/Quasi Public, and is the Emerald Pond Park. <br />4. That the existing primary structure was constructed in 1992. It is unknown when the <br />existing porch was constructed, as there is no building permit and encroaches 10 feet into <br />the rear yard setback. <br />5. There is no evidence that a variance was granted by the City of Ramsey to allow the <br />existing structure encroachment. <br />6. That the Applicant is proposing to enclose the 280 square foot porch. <br />That Section 117-111 of the Ramsey City Code requires a 30 -foot rear yard setback. <br />8. That the Subject Property is a pie -shaped lot at the end of the cul-de-sac. <br />12 <br />
