On October 26, 2010, the City Council postponed action on the Home Occupation and Staff was directed <br />to draft Findings of Fact to support a denial of the permit. Staff has met with the Applicant to inform <br />him of the City Council action. Mr. Dahl would like to make a request to the City Council to consider <br />allowing the enclosed trailer to be screened with a six (6) foot tall fence and require that all non-resident <br />employees carpool to the Subject Property so that only one (1) vehicle is parked in the driveway related <br />to non-resident employees. The Applicant is interested in a level in which he would be allowed some <br />degree of a home occupation on the Subject Property. Staff suggested storing only the enclosed trailer on <br />the Subject Property within the existing detached garage and meeting non-resident employees at a park- <br />and-ride lot in the area. This way carpooling can still be accomplished without additional strain on the <br />surrounding neighborhood. <br />On November 2, 2010, Staff completed a follow up inspection of the Subject Property to verify <br />information that the Applicant provided that the number of items had been reduced. The inspection <br />revealed five (5) items on the driveway and one (1) item on the street that appeared to be related to the <br />Home Occupation. At least two of the vehicles were equipped with snow plows. In addition, one (1) <br />mower was parked in the front yard as well as several miscellaneous items such as leaf blowers, plastic <br />storage containers, and propane heaters. <br />Recommendation: <br />The Planning Commission reviewed the request for a home occupation to operate a lawn care and <br />landscape service on the Subject Property at a Public Hearing on October 7, 2010, and recommended <br />approval of the request, contingent upon revisions as shown on the draft Permit attached hereto. <br />Council Action: <br />Motion to adopt a resolution adopting Findings of Fact related to the Applicant's request for a home <br />occupation permit. <br />-and- <br />Motion to adopt/not adopt a resolution approving the Applicant's request for a home occupation permit <br />based on the findings of fact. <br />-or- <br />Motion to deny the request for a home occupation permit based on findings of fact. <br />Review Copies to: <br />Pla g M er City Attorney <br />J�Ic <br />Deputy City Administrator/Director of CD <br />Attachments: <br />a) Site location map <br />b) Site Photos <br />C) Response from Applicant <br />d) DRAFT Planning Commission Minutes <br />e) Proposed findings of fact <br />f) Proposed home occupation permit <br />CC: 11.09.2010 <br />
