-152- <br /> <br />18. <br /> <br />19. <br /> <br />20. <br /> <br />including these provisions in 'the covenants drafted as a part of the homeowner's <br />association. <br /> <br /> SECTION m. <br />PERxMITS AND OCCUPANCY <br /> <br />Requirements for Building and Occupancy Permits. No building permit for any lot in <br />the Plat shall be issued until: (a) a Class 5 driving surface is installed to within 300 feet of <br />the structure; (b) a Certificate of Survey, including that survey information required by <br />the CITY has been supplied to the City Building Official; and (c) all the financial <br />guarantees required by the CITY have been satisfied. All foundation approvals will <br />require a certificate of elevation verifying that the actual elevation is in compliance with <br />the approved grading and drainage plan. No occupancy permit for any lot in the Plat shall <br />be issued until: (a) vehicular access to the lot is provided including the installation of at <br />least one layer of bituminous surfacing; (b) all utilities are in place, operational and <br />accepted by the CITY;' (c) the City has been provided with a certificate of grading for any <br />lot with a slope flatter than 2%; and (d) boulevard sod and landscape tree, or escrow for <br />same, have been provided. <br /> <br /> SECTION IV <br />PARK DEDICATION <br /> <br />Land and Cash Contribution. The Plat is located in the Sunfish Recreation District. <br />Park dedication requirements shall be satisfied by a dedication of 4.8 acres of parkland as <br />shown on the Final Plat and a cash payment in the amount of One Hundred Six Thousand <br />Nine Hundred and Thirty Dollars and no cents ($106,930). ( 170 lots x $1,700.00 per <br />Unit x 37% [37% is the Park Dedication remaining to be fufilled less 4.8 acres dedicated <br />as park]). This payment shall be made to the City prior to the release of the Final Plat for <br />recording. The Park Dedication for Lot 1, Block 9 will be a cash contribution and shall be <br />paid after site plan review approval for the lot, based upon the number of Units permitted, <br />but shall occur prior to the issuance of a building permit for a structure(s) 'on the lot. <br /> <br /> SECTION V <br />TRANSPORTATION AND LANDSCAPING <br /> <br />Trail Fee. The City's trail development fee for 2002 is Four Hundred Dollars and no <br />cents ($400.00) per Unit. Trail construction credit will be give for each segment of trail <br />within the plat at a cost agreed to between the DEVELOPER and the CITY. These <br />internal trails are estimated at approXimately 2,870 feet. The trail adjacent and parallel to <br />CSAH #5 [Nowthen Blvd.] is estimated at 830 feet in'length, and is not credit eligible. <br />Therefore, a payment in the amount of Twenty Seven Thousand Eight Hundred Twenty <br />Dollars and no cents ($27,820.00) (170 lots x $400/Iot= $68,000-$40,180=$27,820) shall <br />be paid to the City prior to releasing the Final Plat for recording..
