Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #02-05- <br /> <br />RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO <br />EXCEED OUTDOOR STORAGE RESTRICITONS ESTABLISHED IN THE BW - <br />BUSINESS WAREHOUSE DISTRICT, BASED ON FINDINGS OF FACT # , <br />AND DECLARING THE TERMS OF SAME. <br /> <br /> WHEREAS, Tom Sauter, hereinafter referred to as "Permittee", has properly applied to <br />the City of Ramsey (the "City") for a conditional use permit (Permit) to exceed outdoor storage <br />restrictions on property located at 6651 141~' Avenue and legally described as follows: <br /> <br />Lot 1, Block 1, Gateway North Industrial Park No. 5, Anoka County, Minnesota. <br /> <br />("Subject Property") <br /> <br /> WHEREAS, the Planning Commission met on May 2, 2002, conducted a public hearing <br />and recommended that the City Council approve the request for a conditional use permit to <br />exceed outdoor storage restrictions; and <br /> <br /> WHEREAS, the City Council met on May 23, 2002 to review the request for a <br />conditional use permit to exceed outdoor storage restrictions on the Subject Property. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />This permit is issued pursuant to Section 9.03.04A of the Ramsey City Code. The conditions of <br />this permit are as follows: <br /> <br />1) <br /> <br />The Permittee is herein allowed to exceed the 10% permitted outdoor storage area by an <br />additional 21%, which, equates to a total outside storage area of 31% of the Subject'Property, <br />or 3.5 acres (l 53,475 square feet). <br /> <br />2) The outside storage area is restricted to the bituminous and aggregate surfaced areas as <br /> outlined in the attached Exhibit A. <br /> <br />3) <br /> <br />That the Permittee shall be required to provide additional screening along the northern <br />boundary line of the Subject Property within 60 days of City Council approval of this Permit <br />and additional planting species and varieties must be approved by the City prior to <br />installation. <br /> <br />4) That all costs incurred by the City in administering and enforcing this Permit shall be the <br /> responsibility of the Permittee. <br /> <br />5) That the City Administrator or his or her designee shall have the right to inspect the Subject <br /> Property for compliance and safety purposes at any time. <br /> <br />6) That if any provision of this Permit shall be declared void or unenforceable, the other <br /> provisions shall not be affected but shall remain in full force and effect. <br /> <br />7) That this Permit shall not be considered modified, altered, changed or amended in any respect <br /> unless in writing and signed by the City and the Permittee. <br /> <br />-241 - <br /> <br /> <br />
