Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #02-05- RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO EXCEED OUTDOOR STORAGE RESTRICITONS ESTABLISHED IN THE BW - BUSINESS WAREHOUSE DISTRICT, BASED ON FINDINGS OF FACT # , AND DECLARING THE TERMS OF SAME. WHEREAS, Tom Sauter, hereinafter referred to as "Permittee", has properly applied to the City of Ramsey (the "City") for a conditional use permit (Permit) to exceed outdoor storage restrictions on property located at 6651 141~' Avenue and legally described as follows: Lot 1, Block 1, Gateway North Industrial Park No. 5, Anoka County, Minnesota. ("Subject Property") WHEREAS, the Planning Commission met on May 2, 2002, conducted a public hearing and recommended that the City Council approve the request for a conditional use permit to exceed outdoor storage restrictions; and WHEREAS, the City Council met on May 23, 2002 to review the request for a conditional use permit to exceed outdoor storage restrictions on the Subject Property. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: This permit is issued pursuant to Section 9.03.04A of the Ramsey City Code. The conditions of this permit are as follows: 1) The Permittee is herein allowed to exceed the 10% permitted outdoor storage area by an additional 21%, which, equates to a total outside storage area of 31% of the Subject'Property, or 3.5 acres (l 53,475 square feet). 2) The outside storage area is restricted to the bituminous and aggregate surfaced areas as outlined in the attached Exhibit A. 3) That the Permittee shall be required to provide additional screening along the northern boundary line of the Subject Property within 60 days of City Council approval of this Permit and additional planting species and varieties must be approved by the City prior to installation. 4) That all costs incurred by the City in administering and enforcing this Permit shall be the responsibility of the Permittee. 5) That the City Administrator or his or her designee shall have the right to inspect the Subject Property for compliance and safety purposes at any time. 6) That if any provision of this Permit shall be declared void or unenforceable, the other provisions shall not be affected but shall remain in full force and effect. 7) That this Permit shall not be considered modified, altered, changed or amended in any respect unless in writing and signed by the City and the Permittee. -241 -
