I I I I '1 I I i I i I I I I Conformance with Plan. The Plat shall be developed pursuant to the Final Plat Plans consisting of two (2) sheets, prepared.by James R. Hill, Entitled Birch Hill Lodges. Incorporation of All City Code Requirements. That the recitals above and the applicable provisions of the citY Charter, Subdivision Code, Zoning Code and Public Improvement Code of the CITY, as mended to date hereof, are incorporated herein by reference. Stage I Improvements Required. The improvements the CITY requires the DEVELOPERS to construct within the Plat are as follows: g. h. i. Trunk and lateral sanitary sewer sYstem Trunk and lateral watermains and appurtenances Streets with concrete curb and gutter Trunk and lateral storm drainage facilities Site grading and permanent erosion control Natural gas Telephone service Electric service Street lights (installment arranged by CITY during Stage I Improvements and paid for by DEVELOPER as stage II Improvement) Sidewalks and Trails (" Stage I Improvements") The DEVELOPER agrees to construct the Stage I Improvements according to the terms and conditions of this agreement and in accordance with DEVELOPER'S plans submitted to the CITY. Said plans shall be in general conformance with the Grading Plan prepared by James R. Hill, dated February 21, 2001, revised The final construction plan for the Stage I Improvements shall be in conformance with said plan prepared by Jmes R. Hill, dated February 26, 2002, revised The DEVELOPER herein agrees to provide the CITY was a copy of the agreement signed between the DEVELOPER and the Lord of Life Church for a grading easement being requested by the DEVELOPER to grade onto a portion of the Lord of Life Church property. In the event that the DEVELOPER and the Lord of Life Church do not sign an agreement for the grading easement being requested on the Lord of Life Church property, the DEVELOPER must submit a grading plan to the CITY that will provide for the construction of a retaining wall along the southeastern boundary line of the plat and is subject to the City Engineers approval. The DEVELOPER shall be responsible for completing the rough grading and providing lot corner stakes prior to the installation of underground utilities. Stage I Improvements Completion Date. The Stage I Improvements shall be completed on or before April 1, 2003. -137-
