The public street and utility easement was put in <br />Place when the Northfork PUD plan was adopted, in anticipation of the extension of 153~d <br />Avenue. The street was subsequently extended in a different location. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br />f) <br />g) <br /> <br />Site location map <br />Exhibit of proposed easement vacation <br />Concept layout - Inter-Regional Corridor Highway 10 Management Plan <br />Aerial half-section map exhibit <br />Draft City Council meeting minutes, dated October 22, 2002 <br />Proposed easement vacation ordinance <br />Proposed resolution to deny easement vacation <br /> <br />Notification: <br /> <br />In accordance with State Statute, staff attempted to notify all persons owning property within 350 <br />feet of the subject property of the request for easement vacation and related public hearing. <br /> <br />Observations: <br /> <br />At the October 22, 2002 meeting, Council questioned the usefulness of the easement to <br />accommodate an interchange with Highway 10 in view of the recent discussion of the highway <br />being upgraded to freeway standards. Council suggested that a location midway between Jarvis <br />St. and Alpine Dr. might be an acceptable compromise. Attached is the concept handout of the <br />area taken from the Inter-Regional Corridor Highway 10 Management Plan, which has been <br />annotated to illustrate the alignment of the subject easement vacation. Also attached is a larger <br />scale aerial half-section map that illustrates the alignment relative to the current features over the <br />Northfork Links golf course. The location of 156th St., its future extension, and the MnDoT <br />mechanical building have also been annotated onto this aerial. <br /> <br />Council also requested further information on whether or not the City paid for the easement at <br />the time of its dedication. Staff has contacted Anoka County and reviewed development <br />agreements and has found no evidence that the City paid for the easement. It is also the <br />applicant's position that the City did not pay for the easement. <br /> <br />Recommendation: <br /> <br />Although not without impact, an alignment over this easement could have merit if locating the <br />Highway [0 interchange between Jarvis St. and Alpine Dr. becomes a necessary component of <br />the freeway plan. MNDoT has requested the opportunity to review and Comment on the proposed <br /> <br />-129- <br /> <br /> <br />
