-42- <br /> <br />Chairperson Nixt stated they want to make sure the code is not inconsistent with at a minimum <br />the tree preservation that is associated with this because they want to preserve the trees. <br /> <br />Chairperson Nixt asked Mr. McGee if he had any concerns or issues that has not been worked <br />out with staff. <br /> <br />Mr. McGee stated he did not. <br /> <br />Councilmember Anderson stated she believed they had worked things out with the staff but they <br />have some problems on the Council regarding this development. She stated that she is concerned <br />with just approving the twin home portion of the development without looking at the overall <br />development, especially the sixteen unit buildings. Part of her concern is if they put in the first <br />section and try to work with the remaining sections, they do not have the flexibility they had <br />before they developed the first section. She would like to have a good look at the entire <br />development before they approve the first phase. She stated she was concerned with changing <br />city code to permit sixteen unit buildings. Council member Anderson is also concerned that in <br />the second phase, these are not townhomes, they are condominiums and Ramsey has not <br />processed condominiums in the law. <br /> <br />Principal Planner Trudgeon stated Birch Hill Lodges is condos, Pdvenwick is proposed to be <br />condos, and they would plat lots as the whole building and then continue forward from there. <br /> <br />Councilmember Anderson stated she was concerned with approving the first section because she <br />thought they would try to change the rules to build sixteen unit buildings. <br /> <br />Chairperson Nixt stated this was a valid point but in the beginning Mr. McGee was told they may <br />not be able to put sixteen units on the property and this was not going to impact the decision <br />made. <br /> <br />Chairperson Nixt stated he shared Councilmember Anderson's concerns but it is not his <br />understanding of what is happening here. He stated he is looking at the outlot as a stand-alone. <br /> <br />Principal Planner Trudgeon stated this was on the Council's agenda and tabled until their next <br />meeting for requests that the developer bring sketch plans for both areas and if they could not do <br />the sixteen units, show how they would develop the second part. <br /> <br />Mr. McGee stated what it comes down to is that they have to develop the entire piece of property, <br />they cannot have outlots. <br /> <br />Principal Planner Trudgeon stated this is inconsistent and there is some desire to know what is <br />going to be developed on the Outlots. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Kociscak, to approve the site plan of <br />Villas of Meadow Point contingent upon compliance with City Staff review letter dated <br /> <br />Planning Commission/October 10, 2002 <br /> Page 16 of 20 <br /> <br /> I <br /> ! <br /> i <br /> I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br />I <br />I <br /> <br /> <br />
