ANDREWS ADDITION; <br />CASE OF ANTHONY MOULDER <br /> By: Chris Anderson, Community Development Assistant <br /> <br />Background: <br /> <br />Anthony Moulder, who resides at 16271 Royal Road (Lot 4, Block 3, Northfork 'Oaks Third <br />Addition) has applied for an Administrative Subdivision to acquire a portion of Lot 3, Block 3, <br />Northfork Oaks Third Addition from his adjoining neighbor to the south. When the cement work <br />for the applicant's driveway and garage pad were completed, the pad was in violation of the side <br />yard setback for accessory structures. The Administrative Subdivision will enable the applicant <br />to comply with the accessory structure side-yard setback as determined in City Code (Section <br />9.20.11). <br /> <br />In conjunction with Administrative Subdivisions, a routine pi'ocedure is to vacate the standard <br />drainage and utility easements on an existing common property line and dedicate replacement <br />drainage and utility easements on what will be the new common property line. <br /> <br />The following items are enclosed: <br /> <br />a) <br />b) <br /> <br />c) <br />d) <br /> <br />Site location map <br />Exhibit identifying Lots 3 & 4, Block 3, Northfork Oaks Third Addition (Parcels <br />A & C respectively, on the Surveyor's Certificate) and the drainage and utility <br />easements to be vacated <br />Proposed resolution to approve proposed Registered Land Survey <br />Proposed ordinance to vacate drainage and utility easements <br /> <br />Notification: <br /> <br />No notification is required for Administrative Subdivisions. In accordance with State Statue, <br />property owners within 350 feet of the subject property were notified of the public hearing to <br />consider vacating the existing drainage and utility easements on current common property lines. <br /> <br />Observations: <br /> <br />Administrative Subdivisions are approved at a City Staff level and are used for the conveyance <br />of property between adjacent landowners. Generally, the instrument used to record the land <br />conveyance approved by City Staff is a quit claim deed. However, in the case of Torrens <br />property, the only instrument that can be used to record the conveyance is a Registered Land <br />Survey. Registered Land Surveys require City Council approval. Therefore, it is necessary for <br />the City Council to review and approve this Administrative Subdivision. Both Lots 3 and 4 will <br />continue to maintain compliance with the minimum lot size for Northfork after the conveyance <br />of the property. <br /> <br />As part of the Administrative Subdivision, Staff is also taking the necessary steps to vacate the <br />standard drainage and utility easements on the current common property line between the two <br />neighbors. The City Engineer has verified that there are no drainage structures within the <br />existing easements to be vacated. The applicant will be required to provide the City with <br />replacement easements on the new common property line with his neighbor. <br /> <br />-159- <br /> <br /> <br />
