I I I I I I I I I i I I I Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #02-10- A RESOLUTION DENYING THE ISSUANCE OF A coNDITIONAL USE PERMIT TO DAVID AND SANDRA SHAPPELL TO EXCEED THE SIZE RESTRICTIONS FOR DETACHED ACCESSORY BUILDINGS ON PROPERTIES LOCATED OUTSIDE THE METROPOLITAN URBAN SERVICE AREA (MUSA) WHEREAS, David and Sandra Shappell (Permittees) have properly applied for a conditional use permit to construct an accessory structure that will exceed the size limits established in Section 9.11.02 of the Ramsey City Code on the property generally known as 9325 164t~' Lane NW and legally described as follows: Lot 11, Block 1, Northfork Addition, Anoka County, Minnesota (Subject Property). WHEREAS, the Planning Commission conducted a public hearing on October 3, 2002, and tabled the application prior to any action being taken. AND WHEREAS, the Planning Commission reopened the public hearing on October 10, 2002, pursuant to Section 9.03.04 of the Ramsey City Code. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. That based on Findings of Fact # a conditional use permit to construct an accessory structure on the Subject Property that will exceed the size restrictions is hereby denied. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember ., and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same: and the following abstained: and the following were absent: whereupon said resolution was declared duly adopted by the Ramsey City Council on this the 22nd day of October, 2002. ~ -191-
