I <br />I <br /> <br />Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br />RESOLUTION # 02-10- <br /> <br />I <br />I <br />I <br />I <br />I <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />TO EXCEED THE ACCESSORY BUILDING SIZE RESTRICTION BASED ON <br />FINDINGS OF FACT # AND DECLARING TERMS OF SAME: <br /> <br /> WHEREAS, David and Sandra Shappell (Permittee) have properly applied for a <br />conditional use permit to exceed the accessory building size restriction for properties located <br />outside the Metropolitan Urban Service Area (MUSA) established in section 9.11.02 "Accessory <br />Uses" of City Code on the property generally known as 9325 164t~ Lane NW and legally <br />described as follows: <br /> <br />Lot 11, Block 1, Northfork Addition, Anoka County, Minnesota <br /> <br />(Subject Property) <br /> <br />:1 <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />WHEREAS, the Planning Commission met on October 3, 2002, conducted the <br />public heading tabled the application prior to any action being taken. <br /> <br />AND WHEREAS, the Planning Commission reopened the public hearing on <br />October 10, 2002, pursUant to Section 9.03.04 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />o <br /> <br />Based on Findings of Fact # ., a conditional use permit (permit) to exceed the detached <br />accessory building size restriction for properties located outside the MUSA as established in <br />City Code, is hereby granted to David and Sandra Shappell, hereinafter referred to as the <br />"Permittees" <br /> <br />That the total amount of accessory structure space allowed on the property shall not exceed <br />2,730 square feet. <br /> <br />That the construction of the proposed detached accessory building on the Subject Property <br />shall require issuance of a building permit from the City of Ramsey. <br /> <br />That the accessory building shall be properly constructed and maintained in accordance with <br />all applicable Uniform Building Codes. <br /> <br />The Permittee herein agrees that no business or residential use will be operated in the <br />detached accessory building unless such use is permitted in accordance with the City Code. <br /> <br />That this Permit shall be perpetual in duration as long as the terms are herein complied with. <br /> <br />That the Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this Permit. <br /> <br />-193- <br /> <br /> <br />
