I I Councilmember introduced the following resolution and moved for its adoption: RESOLUTION # 02-10- I I I I I A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO EXCEED THE ACCESSORY BUILDING SIZE RESTRICTION BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF SAME: WHEREAS, David and Sandra Shappell (Permittee) have properly applied for a conditional use permit to exceed the accessory building size restriction for properties located outside the Metropolitan Urban Service Area (MUSA) established in section 9.11.02 "Accessory Uses" of City Code on the property generally known as 9325 164t~ Lane NW and legally described as follows: Lot 11, Block 1, Northfork Addition, Anoka County, Minnesota (Subject Property) :1 I I I I I I I I I I I WHEREAS, the Planning Commission met on October 3, 2002, conducted the public heading tabled the application prior to any action being taken. AND WHEREAS, the Planning Commission reopened the public hearing on October 10, 2002, pursUant to Section 9.03.04 of the Ramsey City Code. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: o Based on Findings of Fact # ., a conditional use permit (permit) to exceed the detached accessory building size restriction for properties located outside the MUSA as established in City Code, is hereby granted to David and Sandra Shappell, hereinafter referred to as the "Permittees" That the total amount of accessory structure space allowed on the property shall not exceed 2,730 square feet. That the construction of the proposed detached accessory building on the Subject Property shall require issuance of a building permit from the City of Ramsey. That the accessory building shall be properly constructed and maintained in accordance with all applicable Uniform Building Codes. The Permittee herein agrees that no business or residential use will be operated in the detached accessory building unless such use is permitted in accordance with the City Code. That this Permit shall be perpetual in duration as long as the terms are herein complied with. That the Permittee shall be responsible for all City costs incurred in administering and enforcing this Permit. -193-
