-24- City Engineer Olson noted that the developer would have constructed the infrastructure in 2002. CounCilmember Hendriksen replied that there is no guarantee what type of future development will occur. City Engineer Olson explained that at the time a new .plat came in there would be implications to the storm sewer and it would be the developer's responsibility to pick up the costs for the development. Councilmember Hendriksen stated that he had thought they were saying that they would give the developer credit for money they would collect in the future at today's dollar value. Principal-City Engineer Olson replied that the pipes they would be talking about need to be put in regardless of what goes into the site. Councilmember Hendriksen inquired as to where the initial funds for the infrastructure would come from. City Engineer Olson explai~ed that the up-front costs would be paid for by the developer and then the City would waive any future storm water management fund fees for the site. Councilmember Hendriksen stated that if the pipe goes in the ground today that is when the useful life of the pipe begins. They need to make sure tax payers are covered in the case where the infrastructure is installed and then the development never occurs or it does not occur in a timely manner. The part that bothers him is that they are paying for something based on the anticipation of receiving revenue in the future. City Engineer Olson reviewed the upstream offsite expenditure language. Mayor Gamec left at 6:30 p.m. Councilmember Hendriksen stated that he objects to the City paying for any downstream expenses. He felt that the developer should pay for all costs and 'then be given credit when the development occurs. City Engineer Olson explained that if they were going to require that all downstream facilities be paid for by the developer there would be no reason for a storm water management fund because the City would continue to aCcumulate funds without having to spend anything from the fund. Councilmember Hendriksen and City Engineer Olson reviewed different development scenarios at length. Councilmember Anderson stated that it seemed like if the upstream pipe is mis-sized then maybe that should be rectified by the utility fund rather than by the developer.
