L <br />STAGE I IMPROVEMENTS AND FINANCIAL GUARANTEES <br /> <br />1. City Code Compliance. That the DEVELOPER will develop the Plat in accordance <br />with the applicable provisions of City Code, Section 9.50, entitled "Subdivision". <br /> <br />2. Conformance with Plan. The Plat shall be developed pursuant to the final plat for <br />Mallard Ponds 2~a Addition consisting of one sheet prepared by Bogart, Pederson & Associates, <br />Inc. <br /> <br />3. Compliance with City Code. That the recitals above and the applicable provisions of the <br />City Charter, Subdivision Code, Zoning Code and Public Improvement Code of the CITY as <br />amended to date hereof, are incorporated herein by reference. <br /> <br />4. Stage I Improvements. Stage I Improvements shall consist of sanitary sewer, municipal <br />water, and storm sewer. The installation of these Improvements shah be established as a term of <br />the Development Permit entered into with the CITY for the development of the property <br />subsequent to obtaining site plan approval from the City Council. <br /> <br />5. Stage I Improvements Required. The improvements the City requires the DEVELOPERS <br />to construct within the Plat are as follows: <br /> <br />Trunk and lateral storm drainage facilities <br />Lot grading <br />Temporary and permanent erosion control facilities <br />Natural gas <br />Telephone service <br />Electric service <br /> <br />("Stage I Improvements") <br /> <br />The DEVELOPER agrees to construct the Stage I Improvements according to the terms <br />and conditions of this agreement and in accordance with DEVELOPER'S plans submitted <br />to the CITY. Said plans shall be in general conformance with the Grading Plan and Final <br />Construction Plan prepared by Bogart, Pederson & Associates dated August 28, 2002, <br />revised <br /> <br />The DEVELOPER shall be responsible for completing the rough grading and providing <br />lot corner stakes prior to the installation of underground utilities. <br /> <br />w <br /> <br />Sewer and Water Trunk Fees.. Sewer and Water Trunk fees were satisfied as part Of the <br />Flintwood Hills Second Addition subdivision. <br /> <br />Stage I Improvement Completion Date. The Stage I Improvements shall be completed <br />on or before November 1, 2003. <br /> <br />-271- <br /> <br /> <br />
