10. 11. I2. LIGHTING. Any~lighting installed on the structure or in the parking lot is subject to the prior approval of the City Engineer and shall be designed so as to deflect light away from County Road #116 and Dysprosium Street. BUII, DING FACADE. The Permittee agrees to construct all building faces of the same material as listed on the Building Elevation Plan prepared by Klick Inter Arch Design dated September 5, 2002. INSPECTION FEES: The Permittee shall be responsible for all inspection costs incurred by the City related to the installation of the Required Improvements~ The Permittee shall make a cash deposit into the appropriate escrow account at the City and the City shall have the authoritY to draw upon these funds for the purpose of compensating for inspection services. The amount of the deposit shall be equal to five percent (5%) of the estimated cost of the Required Improvements or Seven Thousand Dollars and no cents ($7,000). Upon completion of the Improvements to the satisfaction of the City, any surplus balance remaining in the City's escrow account shall be refunded to the Permittee. STORMWATER MANAGEMENT FEE. The City has enacted a Stormwater Management Fee in the amount of Three Thousand Seven Hundred Forty One Dollars ($3,741.00) per commercial acre. The amount of StormWater Management Fee due on the Site is Three Thousand Five Hundred Sixteen Dollars and no cents (.94 acres x $3,741.00). A cash payment will be required prior to the City releasing the Building Permit. REQUIREMENTS FOR BUILDING PERMIT AND CERTIFICATE OF OCCUPANCY. No building permit for the Site will be issued until the Permittee-has: a) signed and returned this Development Permit; b) the plat for Mallard Ponds 2nd Addition has been recorded at the office of Anoka County; c) payment of all fees required by the City; and d) submittal of an acceptable landscaping plan for Lot 96, Block 1, Mallard Ponds. No Certificate of Occupancy for the structure will be issued until: a) the Required Improvements are accepted by the City; and b) the landscaping maintenance-guarantee has been provided IMPROVEMENT CONSTRUCTION SCHEDULE. The Required ImProvements shall be completed before November 1, 2003. ESCROW CHARGES. In order to insure the installation of the Required Improvements in accordance with City specifications and in a timely manner, the Permittee shall be required to deposit with the City a cash escrow or letter of credit, approved as to form by the City, in the amount of Twenty Thousand Six Hundred Fifty Dollars and no cents ($20,650.00), which is 150% of the City's estimated cost of the Improvements. Prior to the issuance of the building permit, all financial guarantees must be provided as required herein. Upon completion of the construction of the Required Improvements, the financial guarantee shall be returned to the Permittee and the Permittee shall be required to provide the landscaping maintenance guarantee described in Item #13 of this Development Permit.
