10. <br /> <br />11. <br /> <br />I2. <br /> <br />LIGHTING. Any~lighting installed on the structure or in the parking lot is subject to the <br />prior approval of the City Engineer and shall be designed so as to deflect light away from <br />County Road #116 and Dysprosium Street. <br /> <br />BUII, DING FACADE. The Permittee agrees to construct all building faces of the same <br />material as listed on the Building Elevation Plan prepared by Klick Inter Arch Design <br />dated September 5, 2002. <br /> <br />INSPECTION FEES: The Permittee shall be responsible for all inspection costs <br />incurred by the City related to the installation of the Required Improvements~ The <br />Permittee shall make a cash deposit into the appropriate escrow account at the City and <br />the City shall have the authoritY to draw upon these funds for the purpose of <br />compensating for inspection services. The amount of the deposit shall be equal to five <br />percent (5%) of the estimated cost of the Required Improvements or Seven Thousand <br />Dollars and no cents ($7,000). Upon completion of the Improvements to the satisfaction <br />of the City, any surplus balance remaining in the City's escrow account shall be refunded <br />to the Permittee. <br /> <br />STORMWATER MANAGEMENT FEE. The City has enacted a Stormwater <br />Management Fee in the amount of Three Thousand Seven Hundred Forty One Dollars <br />($3,741.00) per commercial acre. The amount of StormWater Management Fee due on <br />the Site is Three Thousand Five Hundred Sixteen Dollars and no cents (.94 acres x <br />$3,741.00). A cash payment will be required prior to the City releasing the Building <br />Permit. <br /> <br />REQUIREMENTS FOR BUILDING PERMIT AND CERTIFICATE OF <br />OCCUPANCY. No building permit for the Site will be issued until the Permittee-has: a) <br />signed and returned this Development Permit; b) the plat for Mallard Ponds 2nd Addition <br />has been recorded at the office of Anoka County; c) payment of all fees required by the <br />City; and d) submittal of an acceptable landscaping plan for Lot 96, Block 1, Mallard <br />Ponds. No Certificate of Occupancy for the structure will be issued until: a) the Required <br />Improvements are accepted by the City; and b) the landscaping maintenance-guarantee <br />has been provided <br /> <br />IMPROVEMENT CONSTRUCTION SCHEDULE. The Required ImProvements <br />shall be completed before November 1, 2003. <br /> <br />ESCROW CHARGES. In order to insure the installation of the Required Improvements <br />in accordance with City specifications and in a timely manner, the Permittee shall be <br />required to deposit with the City a cash escrow or letter of credit, approved as to form by <br />the City, in the amount of Twenty Thousand Six Hundred Fifty Dollars and no cents <br />($20,650.00), which is 150% of the City's estimated cost of the Improvements. Prior to <br />the issuance of the building permit, all financial guarantees must be provided as required <br />herein. <br /> <br />Upon completion of the construction of the Required Improvements, the financial <br />guarantee shall be returned to the Permittee and the Permittee shall be required to provide <br />the landscaping maintenance guarantee described in Item #13 of this Development <br />Permit. The determination of completion of the construction of' the Required <br />Improvements shall be made by the City Council after consultation with the City <br /> <br />'293- <br /> <br /> <br />
