Access to Lot 1, Block 1, shall be from County Road #27 (179~ Lane <br />N.W.) and an access permit shall be obtained from Anoka County for said access. ACcess <br />rights for the remainder of the frontage on County Road #27 shall be dedicated to the <br />Anoka County on the final plat. The DEVELOPER shall' also dedicate an additional 27 <br />feet of right-of-way to County Road #27, adjacent to Lot 1, Block 1. <br /> <br />Drainage and Utility Easements. The standard 10 foot wide drainage and utility <br />easements shall be dedicated along the perimeter of each o£ Lot 1, Block 1. The Rogers <br />Lake delineation shall also be encumbered with a drainage and utility easement on the <br />final plat. <br /> <br /> SECTION II <br />PERMITS AND OCCUPANCY <br /> <br />Requirements for Building and Occupancy Permits. No building permit for any lot in <br />the Plat shall be issued until: (a) a Class 5 driving surface is installed to within 300 feet <br />of the structure; (b) a Certificate of Survey, including that survey information required <br />by the CITY, has been supplied 'to the City Building Official upon his/her request; and <br />(c) all the financial guarantees required by the CITY have been satisfied. No occupancy <br />permit for any lot in the Plat shall be issued until: (a) all utilities are in place, operational <br />and accepted by the CITY; and (b) two landscape trees, or escrow for same, has been <br />provided. <br /> <br />Variance To Structure Setback Regulations. The Plat is located in the Rogers Lake <br />Shoreland Overlay District for which there is a two-hundred (200) foot setback from <br />Rogers Lake and a fifty'(5.0) foot setback from County Road #27. On November 7, 2002, <br />the Board Of Adjustment granted a variance to the established setbacks from Rogers. <br />Lake and County Road #27. Al1 structures constructed on Lot 1, Block 1 shall maintain a <br />minimum setback of one-hundred (100) feet from the ordinary high water mark of Rogers <br />Lake and a setback of 40 feet from the front property line adjacent to County Road #27 <br />(which equates to a total of 100 feet from the centertine o.f County Road #27). <br /> <br /> III. <br />PARKS, TRAILS, STORMWATER, LANDSCAPING <br /> <br />Park Dedication. The Plat is in the Rogers Lake Park District. The DEVELOPER <br />shall satisfy the park dedication requirement for the Plat with a cash payment of One <br />Thousand Seven Hundred dollars and no cents ($1,700.00) (1 lot x $170Q.00 per lot). <br /> <br />-99- <br /> <br /> <br />
