WHEREAS, approval of the Final Plat is given pursuant to the City's Subdivision Code <br />Section 9.50.05 (Subd. 1) entitled "Division or Consolidation of platted Lots". <br /> <br /> WHEREAS, no expenditure of CITY funds will be made until City Code escrow <br />requirements have been fulfilled by the DEVELOPER. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br /> SECTION I . <br />STAGE I IMPROVEMENTS AND FINANCIAL GUARANTEES <br /> <br />City Code Compliance. The CITY approves the Plat conditioned on the DEVELOPER <br />developing the Plat in accordance with the applicable provisions of City Code, Section 9.50, <br />entitled Subdivision. <br /> <br />2. Conformance with Plan. The Plat shall be developed pursuant to the Final Plat plans, <br /> entitled White Oak Addition, consisting of two (2) sheets, prepared by John Oliver and <br /> Associates, and received November 12, 2002, grading, drainage, and erosion control plans <br /> consisting of two (2) sheets, prepared by John Oliver and Associates dated October 11, 2002, <br /> and storm sewer and street improvement plans consisting of seven (7) sheets,' prepared by <br /> John Oliver and Associates dated October 1 I, 2002. <br /> <br />3. Incorporation of All City Code Requirements. That the recitals above and the applicable <br /> provisions of the City Charter, Subdivision Code, Zoning Code and Public Improvement <br /> Code of the CITY, as amended to date hereof, are incorporated herein by reference. <br /> <br />4. Access to Lots. Access to Lots 2, 3, 4, and 5 shall be'from an extension of 158th Lane NW <br /> into the subject property. Anoka County has requested right-of-access dedication on Lots 2 <br /> and 5. Lot 1 will gain access from County Road 56; once the location of this driveway is <br /> determined, the remainder of the road frontage will need to be dedicated to Anoka County. <br /> <br />o <br /> <br />o <br /> <br />Drainage and Utility Easements. The standard 1 O-foot (5 feet on common property lines) <br />drainage and utility easements shall be dedicated along the perimeter of each.of the five lots. <br />All areas where wetlands are located shall be' dedicated as drainage and utility easements on <br />those lots that are less than 10 acres in size. <br /> <br />Stage I Improvements Required/Phasing Plan.'
