-134- <br /> <br /> WHEREAS, on November 26, 2002, pursuant to Resolution #02-11- ., the CITY <br />approved the final plat of the Subject Property which plat is known as RAMSEY DENTAL <br />CLINIC ADDITION (the "Plat") contingent on certain requirements, including <br />DEVELOPERS and CITY entering into this agreement; and <br /> <br /> WHEREAS, the Plat consists of one (1) lot and one (1) outlots totaling approximately <br />4.53 acres; and <br /> <br /> WHEREAS, approval of the Final Plat is given pursuant to the City's Subdivision Code <br />Section-9.50.05 (Subd. 1) entitled "Division or Consolidation of platted Lots"; and <br /> <br /> WHEREAS, it is agreed between the DEVELOPERS and the CITY that the Plat is <br />being undertaken in order to assemble land for future subdivision of what will be known as Outlot <br />A, Ramsey Dental Clinic Addition; and <br /> <br /> WHEREAS, no expenditure of CITY funds will be made until City Code escrow <br />requirements have been fulfilled by the DEVELOPERS. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPERS agree as follows: <br /> <br />IMPROVEMENTS AND UT[LITHgS <br /> <br />Drainage and Utility Easements. Drainage and utility easements shall be dedicated as <br />shown on the final plat. <br /> <br />Sewer and Water 'Trunk Fees. At this time, no sewer and water trunk fees are due <br />since the only new lot being Created is'an outlot which is ineligible to be developed until it <br />is resubdivided. The Sewer and Water Trunk Fees shall be charged per the fee schedule in <br />effect at the time when the SubjeCt Property is replatted. <br /> <br />PARKS, TRAILS, STORMWATER, LANDSCAPING <br /> <br />Park Dedication. The Plat is in the Greenland Hills Park District. At this time, no park <br />dedication fees are due since the only new lot being created is an outlot which is ineligible <br />to be developed until it is replatted. <br /> <br />Trail Development Fee.
