Further discussion: Councitrnember Anderson stated that she was not sure that they will get any more information from Pros ource Technologies than they have already received from Hakanson Anderson. Mr. McGee stated that they have no problems with complying with the guidelines recommended for The Poads development. Councilmember Anderson stated that she was questioning if they need another environmental opinion. City Attorney Goodrich stated that if the Council feels they have received enough information regarding the petition they can adopt the findings of fact relating to the issue. Motion was withdrawn. Councilmember Hendriksen inquired if the $I50,000 City contribution for the extension of sanitary sewer lines had beea increased since the last meeting. Principal City Engineer Olson replied that the figure has always been $150,000. Principal Piarmer Trudgeon presented a resolution regarding findings of fact indicating that an EAW does not need to be conducted, for Council consideration. Mayor Garnet inquired if they should add a finding regarding the Hakanson Anderson letter. City Attorney Goodrich recommended that a finding be added as follows: "That the City Council adopts the contents of the letter dated October 18, 2002 draPred by Hakanson Anderson responding to. the citizen petition." " Motion by Councilmember Kurak, seconded by Councilmember Anderson, to adopt Resolution #02-10-275 adopting Findings of Fact #0635 and making a determination that an environmental assessment worksheet 0EAW) does not need to be conducted for the development known as Villas of Meadow Point as amended by the City Attorney and handed out on the blue sheet of paper by staff at the meeting. Motion carded. Voting Yes: Mayor Gamec, and Councilmembers Kurak, and Anderson. Voting No: Councilmembers Hendriksen, and Zimmerman. Motion by CoUncilmember Kurak, seconded by Councilmember Anderson, to adopt Resolution #02-10-276 approving preliminary plat contingent on the following items. 1. The applicant complying with City staff review letter dated August 20, 2002, revised September 20, 2002, revised October 4, 2002, revised October 18, 2002. 2. The applicant receiving site plan approval of the two-unit townhomes~ 3. Language being inserted in the Development Agreement that define the financial responsibilities between the City and the developer regarding extension of sanitary sewer trunk lines, which has been defined as a, b, c, and d on pages 301 and 302 of this agenda.
