-88- 18. Land and Cash Contribution. SECTION IV PARK DEDICATION The Plat is located in the Oak Recreation District. Park dedication requirements shall be satisfied by a cash payment in the amount of Eighty Eight Thousand Four Hundred Dollars ($88,400.00) (52 lots x $1,700.00/unit). This payment shall be made to the City prior to the release of the Final Plat for recording. SECTION V TRANSPORTATION AND LANDSCAPhNG 19. Trail Development And Fees. The City Council has enacted a trail development fee in the amount of Four Hundred Dollars and no cents ($400:00) per unit. Therefore, a payment in the amount of Twenty Thousand Eight Hundred Dollars ($20,800.00) (52 lots x $400/lot) shall be paid to the CITY prior to releasing th~ Plat for recording. 20. Sidewalk Construction. The DEVELOPER shall construct and pave, in accordance with CITY standards, a five (5) foot wide concrete sidewalk with pedestrian ramps in locations prescribed by the CITY, not to exceed 5% in grade, along public streets. 21. Tree, Shrub and Sod Planting Plan. The addition of trees, shrubs and sod to the Plat shall be in accordance with the approved Landscape Plan referenced in the Site Plan Development Permit. The DEVELOPER is required to submit a Plan for CITY approval that identifies existing tree growth within the Plat that will be protected during construction. The trees to be protected must be identified on the grading plan, and the plan must require the installation of 'tree save fences' prior to land clearing or grading. In addition, the requirement for this Plan shall be fulfilled by the DEVELOPER as follows: a) lX, tinimizing the impact of construction on trees in accordance with Minnesota Extension Service publication "Protecting Trees From Construction Damage" (Publication #NR-FO-6135-S). 22. Tree Disease Prevention and Disposal. The DEVELOPER shall prevent the introduction and spread of tree disease into the residual tree populations of the Plat and adjoining properties as well as mitigate the effects of construction activity on tree health, within and outside of the Plat. The DEVELOPER, in order to protect trees from construction damage shall: a) rnstall physical barriers, such as snow fence, around trees that are to remain after initial grading. The fencing shall be located at the driptine of these 'save' trees. b) Insure that all equipment operators will have readily available, a tree wound dressing and will apply it immediately to damaged oak trees if wounding occurs from April 15 through July 15.
