! <br />! <br /> <br />CASE # <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO EXPAND A <br />LAWFUL NON-CONFORMING READY-MIX PLANT TO INCLUDE <br />A SECOND SILO; CASE OF MARSHALL CONCRETE <br /> By: Sylvia Frolik, Community Development Director <br /> <br />Background: <br /> <br />Marshall Concrete is a lawful nonconforming concrete ready-mix plant located at 14141 Unity <br />Street N.W. The company has determined that their operation is in need of a second product <br />silo. According to City Code, any enlargement or expansion of a lawful nonconforming use <br />must be done so in accordance with City Code. Therefore, Marshall Concrete has applied for a <br />conditional use permit for the addition of the second silo. The following items are enclosed for <br />your information: <br /> <br />Site Location Map <br />Site Plan <br />Grading, Drainage and Erosion Control Plan <br />Facility Elevations <br />Letters from A&R Mfg., Zero Zone Refrigeration, Depot Star <br />Planning Commission meeting minutes dated June 6, 2002 <br />Board of Adjustment meeting minutes dated June 6, 2002 <br />Proposed Findings of Fact <br />Proposed Conditional Use Permit <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br />f) <br />g) <br />h) <br />i) <br /> <br />Notifications: <br /> <br />In accordance with State law, Staff attempted to notify owners of property within 350 feet of the <br />subject property, of the request for a conditional use permit and the June 6 public hearing. <br /> <br />Observations: <br /> <br />The proposed silo will be installed on the north side of the building and is proposed to be 61 feet <br />in height. The exiting silo is 62.5 feet in height. There is a 35 foot height restriction on <br />structures in the Industrial District. On June 6, 2002, the Board of 'Adjustment granted a <br />variance to the height restriction contingent upon the Applicant obtaining a conditional use <br />permit for the installation of the second silo at the facility. <br /> <br />During the Planning Commission consideration of the request for a conditional use permit to add <br />a second product silo to the site, there was a great deal of discussion regarding the existing <br />conditions at the site and the impacts associated with this type of heavy industrial use. The <br />issues discussed dealt with noise, traffic, dust and the need for more intense screening adjacent to <br />1'40th Avenue. <br /> <br />-115- <br /> <br /> <br />
