I <br /> <br />Citizen Input <br /> <br />Mark Koran, 1600 Old Simms Road, Oak Grove, explained he owns the business to the south of <br />this facility. He said he was aware this facility existed when he moved in, but it has signifmantly <br />changed over the last two years. He said the vehicle traffic has significantly increased. Much of <br />the noise was muffled by the 8-foot wall. However, east of the wall there is now more storage of <br />sand and rock, which is triple the size of the original amount. He said he took a picture of the <br />on-site storage of rock. He expressed concern that the plans look as though the silo will be at the <br />back of the building. He also was concerned about the original conditional use permit that <br />allowed the original business to be there. <br /> <br />Community Development Director Frolik explained it is a pre-existing facility before the zoning <br />regulations were in place. <br /> <br />Mr. Koran said he brought the issue of the original conditional use permit up because it seemed a <br />permit would have been needed to pave from the front of the structure to Unity. He asked if the <br />weight limit on 140~' Avenue was 5 or 9 ton. <br /> <br />City Engineer Steve Jankowski answered it is a 9-ton road. <br /> <br />Community Development Director Frolik stated Outlot A is owned by the City, and Outlot B is <br />owned by Marshall concrete. She said the City worked with the Johnson property, and the Ready <br />Mix Property to achieve ownership of Outlot A in order to preserve the trees as a screening. <br /> <br />Chairperson Nixt questioned when that land swap occurred and whether buildings were erected <br />on Outlot B. <br /> <br />Community Development Director Frolik responded the swap was several years ago. There are <br />no buildings on Outlot B; it seems to be used for maneuvering rather than storage. <br /> <br />Mr. Koran asked, if the business would be allowed to gain access from 140t~ if the address for the <br />building was on Unity. He explained he did not want a conditional use permit to affect his <br />business. He said there are some delivery trucks that shake his building and also stated a <br />conversation could not be held in the front of his building due to the noise of the concrete <br />operation. <br /> <br />Chairperson Nixt said the egress can be used as long as it is legal. <br /> <br />Ce. mmunity Development Director Frolik indicated when the land swap occurred, the agreement <br />Was the concrete business could use extra entrances on 140th. <br /> <br />Mr. Koran expressed further concerns in the trucks gaining access off Unity. He said in the past, <br />the trucks would come in on the cemented access on Unity. The delivery trucks were buffered <br />by the trees on one side, and the wall on the other.
