5) That in the event the City determines that there is an accumulation of residual deposits on the public streets resulting from the activities on the Subject Property, the City shall provide the Permit-tee with five (5) days written notice to sweep the streets. If the Permittee fails to comply within the five (5) day time frame, the City or its contractor will sweep the streets and the associated costs shall be the responsibility of the Permittee. City expenses incurred in sweeping the public streets shall be paid with/n thirty (30) days of billing. Failure to compensate the City for the services shall be cause for the City to consider revocation of the CUP and for a special assessment to be levied against the Subject Property and certified to the County Auditor for collection in the manner as taxes and special assessments are certified and collected. 6) That the Permittee herein agrees to upgrade the dust collection systemin the existing silo by December 1, 2002, and to continue to maintain the facility and related equipment with current technology relating to pollution control. 7) That any additional expansions or enlargements of the ready-mix plant shall require application for a new CUP. 8) That this CUP shall become null and void if it is not initiated within 12 months of the date of approval. The Permittee may petition for an extension of time in which to complete the conditional use permit. Such extension shall be requested in writing and filed with the City at least 30 days before the expiration of the original variance. 9) That the Permittee shall obtain all necessary permits prior to commencing any construction of the site improvements or silo. 10) That the Permittee shall be responsible for all City costs incurred in administering and enforcing this CUP. 1'I) That the City shall have the right .to inspect the premises for compliance and safety purposes annually or at .any time, upon reasonable request. That the Permittee agrees that the terms of this Conditional Use Permit shall be binding upon its successors and assigns. 13) In the event the Permittee, or its successors, or assigns, violates the terms of this CUP, said violation shall be grounds for suspension or revocation pursuant to Section 9.03.04 Subd 9 of the City Code. 14) In the event this CUP is declared void or unenforceable by a court or competent jurisdiction, the other provisions shall not be affected but shall remain in full force and effect.
