-204- <br /> <br />Board Member Reeve stated if the lot lines are being drawn and there is only a three foot <br />problem, he would prefer to move the lot line over so a variance is not needed. He agreed most <br />of this is self created. <br /> <br />~Lr. Longfield stated he understands that. <br /> <br />Board Member Reeve stated if it is a self-created hardship it does not meet the criteria for a <br />variance. <br /> <br />Chairperson Nixt agreed it may be possible to slide the east property line three feet towards the <br />west and use a combination of the site plans so the 10-foot setback requirement is met and the <br />needed property on the north side is gained. He displayed a new diagram that would accomplish <br />that option. <br /> <br />Principal Planner Trudgeon drew that option on the site map and explained why it would not <br />work. <br /> <br />Chairperson Ni~ stated if this variance is den/ed, the applicant could request a lot split with a <br />nontypical lot configuration. He stated he does not support that configuration or the removal of <br />the stand of trees. <br /> <br />Board Member Brauer asked if there are plans to move the septic system. <br /> <br />Principal Planner Tmdgeon stated if the variance is approved, the septic system will have to be <br />moved. <br /> <br />Mr. Longfield stated he understands that, has talked with the septic inspector about it, and will <br />have to relocate one drainage line and cut another drainage line short. That would not require the <br />removal of the trees. <br /> <br />Board Member Kociscak noted that this request does not meet finding of fact #6. <br /> <br />ChairPerson Nixt stated if that is applied, then every time someone wanted to locate a building <br />and needed a setback variance, the Board would tell them to cut down trees instead. <br /> <br />Board Member Kociscak noted the lot can be configured in a way that it would work. <br /> <br />Board Member Reeve stated that is true but that lot configuration makes no sense in Ramsey. <br /> <br />Motion by Board Member Kociscak, seconded by Board Member Brauer, to adopt Resolution <br />//02-07-167 adopting Findings of Fact #0623 not favorable to the applicant relating to a request <br />for a variance from Robert Longfield to the minimum lot size modified as follows: 6) "That the <br />special conditions causing the undue hardship do result from the actions of the Applicant."; 7) <br />That if granted, the variance will grant the Applicant special privilege..."; 8) "That if granted, the <br /> <br />Board of Adjustment~July 11, 2002 <br /> Page 5 of 6 <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br />I; <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br /> <br />
