Access to the lots shall be from the existing 177th Ave right-of-way. No <br />additional road right-of-way will be required at this time. However, if Lot 2, Block 1 is <br />subdivided, the DEVELOPER will be required to dedicate right-of-way and construct <br />the public road to the property line unless an alternative way of providing access to the <br />eastern property line is found to be acceptable to the CITY. <br /> <br />Drainage and Utility Easements. The standard 10 foot (5 feet on common property <br />lines) drainage and utility easements shall be dedicated along the perimeter of each of the <br />two lots. All areas where wetlands are located shall be dedicated as drainage and utility <br />easements on those lots that are less than 10 acres in size. <br /> <br /> SECTION H <br />PERMITS AND OCCUPANCY <br /> <br />Requirements for Building and Occupancy Permits. No building permit for any lot in <br />the Plat shall be issued until: (a) a Class 5 driving surface is installed to within 300 feet of <br />the structure; (b) a Certificate of Survey, including that survey information required by <br />the CITY, has been supplied to the City Building Official upon his/her request; and (c) all <br />the financial guarantees required by the CITY have been satisfied. No occupancy permit <br />for any lot in the Plat shall be issued until: (a) all utilities are in place, operational and <br />accepted by the CITY; and (b) landscape tree, or escrow for same, has been provided. <br /> <br />PARKS, TRAILS, STORMWATER, LANDSCAPING <br /> <br />Park Dedication. The Plat is in the Rogers Lake Park District. Lot 2 is the existing <br />homesteads and is exempt from this fee. The DEVELOPER shall satisfy the Park <br />dedication requirement for the Plat with a cash payment of One Thousand Seven Hundred <br />dollars and no cents ($1,700) (1 lots x $1700 per lot). <br /> <br />Trail Development Fee. The City has enacted a trail development fee in the amount of <br />Four Hundred Dollars and no cents ($400.00) per lot. Lot 2 is the existing homesteads <br />and is exempt from this fee. Therefore, a payment for one new lots in the amount of Four <br />Hundred Dollars and no cents ($400.00) shall be paid to the City prior to releasing the <br />Final Plat for recording. <br /> <br />Stormwater Management Fee. The CITY has enacted a Stormwater Management Fee <br />in the amount of Three Hundred Seventy Five Dollars and no cents. ($375.00) per unit.. <br />Lot 2 is the existing homesteads and is exempt from this fee. Therefore, a payment for <br /> <br />-213- <br /> <br /> <br />
