CASE # <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO EXCEED HEIGHT <br />RESTRICTIONS FOR ACCESSORY STRUCTURES; <br /> CASE OF WILLIAM AND ELIZABETH ERHART <br /> By: Megan Wald, Associate Planner <br /> <br />Background: <br /> <br />City Code restricts accessory structure building heights to 16 feet inside the Metropolitan Urban <br />Service Area (MUSA). The total amount of accessory structure space allowed on a parcel is <br />regulated by parcel size. The City received an application from William and Elizabeth Erhart for <br />a conditional use permit to exceed the detached accessory building height established in City <br />Code on the property located at 4740 154th Lane NW. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site Survey <br />c) Application text <br />d) Elevations for accessory structure <br />e) Draft Planning Commission meeting minutes dated August 29, 2002 <br />f) Proposed findings of fact <br />g) Proposed conditional use permit <br /> <br />Notification: <br /> <br />In accordance with State statute, Staff attempted to notify owners of property with/n 350 feet of <br />the Subject Property of the applicants request and the public hearing. <br /> <br />Observations: <br /> <br />The subject property is approximately 4.5 acres in size and is located within the Metropolitan <br />Urban Service Area (MUSA). The applicant is proposing to construct a detached accessory <br />building that would be approximately 22 feet in height, which results in about a 6-foot deviation <br />from City Code. The applicant would like to exceed the 16-foot height restriction in order to <br />match the roofline of the principal structure and provide for addkional overhead storage. <br /> <br />The proposed detached accessory building will comply with accessory structure square footage <br />restrictions established in City Code. City Code currently does not permit accessory structures to <br />be located closer to the front property line than the principal dwelling. The applicant's have <br />applied for a variance in order to place the accessory structure closer to the front property line <br />than the principal structure. The Board of Adjustment will be reviewing the variance request on <br />September 5, 2002. The exterior walls are proposed to be faced with vinyl siding and the roof <br />will be finished with asphalt shingles. The architectural standards are in compliance with City <br />Code. <br /> <br />The Planning Commission held a public hearing and reviewed the request on August 29, 2002. <br />There was no citizen opposition during the public he.aring. <br /> <br />q <br /> <br />-250- <br /> <br /> <br />
