CASE #

REQUEST TO VACATE A PORTION OF
DRAINAGE AND UTILITY EASEMENT IN AMBER RIDGE;
· CASE OF CAROLE NIELSEN
By: Community Development Director Sylvia Frolik
and City En~neer Steve Jankowski

Background:

Carole Nielsen resides at 14950 Argon Street N.W. and is proposing to construct a utility shed in
her back yard. However, a substantial portion of her back yard is encumbered with by a drainage
and utility easement. Ms. Nielsen has submitted a request to vacate a portion of that easement.
The following items are enclosed for your information:

a) Site location map
b) Easement Vacation
dated 8/14/02
c) Proposed ordinance

Observations:

Exhibit prepared

by Hakanson Anderson Associates, Inc.

The City Engineer indicates that at the time Amber P,d'dge was platted, the drainage plan called
for the transmission of runoff from the detention pond located south of the subject property to the
wetland through a wide backyard swale. In 2000, a storm sewer outlet from the wetland to the
north was constructed as a part of the work associated with the TH 47 project. Therefore, the
large drainage easement that was necessary when Amber Ridge was platted is no longer required
due to the subsequent drainage project.

Recommendation:

City Staff recommends adoption of the proposed ordinance to vacate a portion of the drainage
easement on Lot 7, Block 8, Amber Ridge.

Council Action:

Motion to introduce Ordinance #02-
on Lot 7, Block 8, Amber Ridge.

to vacate a portion of the drainage and utility easement

Review Checklist:

City Engineer
City Attorney

CC: 08/19/02

I

-47-
