CASE # <br /> <br /> REQUEST TO VACATE A PORTION OF <br />DRAINAGE AND UTILITY EASEMENT IN AMBER RIDGE; <br />· CASE OF CAROLE NIELSEN <br /> By: Community Development Director Sylvia Frolik <br /> and City En~neer Steve Jankowski <br /> <br />Background: <br /> <br />Carole Nielsen resides at 14950 Argon Street N.W. and is proposing to construct a utility shed in <br />her back yard. However, a substantial portion of her back yard is encumbered with by a drainage <br />and utility easement. Ms. Nielsen has submitted a request to vacate a portion of that easement. <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Easement Vacation <br /> dated 8/14/02 <br />c) Proposed ordinance <br /> <br />Observations: <br /> <br />Exhibit prepared <br /> <br />by Hakanson Anderson Associates, Inc. <br /> <br />The City Engineer indicates that at the time Amber P,d'dge was platted, the drainage plan called <br />for the transmission of runoff from the detention pond located south of the subject property to the <br />wetland through a wide backyard swale. In 2000, a storm sewer outlet from the wetland to the <br />north was constructed as a part of the work associated with the TH 47 project. Therefore, the <br />large drainage easement that was necessary when Amber Ridge was platted is no longer required <br />due to the subsequent drainage project. <br /> <br />Recommendation: <br /> <br />City Staff recommends adoption of the proposed ordinance to vacate a portion of the drainage <br />easement on Lot 7, Block 8, Amber Ridge. <br /> <br />Council Action: <br /> <br />Motion to introduce Ordinance #02- <br />on Lot 7, Block 8, Amber Ridge. <br /> <br />to vacate a portion of the drainage and utility easement <br /> <br />Review Checklist: <br /> <br />City Engineer <br />City Attorney <br /> <br />CC: 08/19/02 <br /> <br />I <br /> <br />-47- <br /> <br /> <br />
