Voting No: None. <br /> <br />Mayor Gamec recessed the regular City Council meeting at 9:09 p.m. <br /> <br />Mayor Gamec called the regular City Council meeting back to order 9:20 p.m. <br />Case #9: <br /> <br />Zimmerman, <br /> <br />Request for Final Plat Approval for Town Center North Minor Subdivision; <br />Case of Andrew Kociscak <br /> <br />Principal Plmmer Trudgeon explained that Andrew Kociscak is requesting a minor subdivision in <br />order to create two lots from a 45 acre parcel. Mr. Kociscak is proposing to split land from the <br />Gilbert Menkveld Tntst parcel located north of County Highway #116 and west of Ramsey <br />Boulevard. Mr. Kociscak is in the process of purchasing 43.72 acres from the Menkveld Trust. <br />The minor subdivision is proposing to consist of two lots, 43.72 acres and 1.3 acres. Mr. <br />Kociscak has an agreement with the Menkveld Trust to purchase a 43.72 acres of the parcel. At <br />the time the agreement was drafted, the Menkveld Trust was holding 1.3 acres for a future <br />convenience gas station, which was eventually denied by the City of Ramsey. At this time, Mr. <br />Kociscak is not planning to buy the 1.3 acre parcel for what they are asking. Thus he is <br />requesting a minor subdivision to break off 43.72 acres so that he may proceed with his plans. <br />This minor subdivision is necessary for Mr. Kociscak and Brightkeys to assemble the land and <br />start the development process. The property contains no structures and there are no requirements <br />for road construction at this time. The sketch plan as shown meets all dimensional requirements <br />under City Code. The land is currently zoned R-2, which allows for townhomes up to a density <br />of seven units per acre. As this minor subdivision will be setting the stage for future <br />development, staff is proposing to defer park and trail fees as well as sewer, water, and <br />stormwater trunlc fees at this time. It is proposed that these fees will be collected at the time of <br />future resubdivision. At their July 11, 2002 meeting, the Plamting Commission reviewed and <br />approved the sketch plan for the Kociscak minor subdivision and instructed the applicant to <br />proceed to the final plat stage. City Staff recommends approval of the final plat contingent upon <br />compliance with City Staff Review letter dated July 18, 2002. <br /> <br />Bill Hughes, Integrated Real Estate Services, Inc. and representing Mr. I(ociscak, explained that <br />the property was originally purchased by Mr. Kociscak four to five years ago when the other deal <br />was pending. At that time, the Menkveld Trust decided to maintain title of that parcel and not <br />sell it. Now it is being sold by Mr. Kociscak to Bfightkeys and in order to give good title to the <br />property, the lot split that was never handled before must now be handled. <br /> <br />Councilmember Hendfiksen asked if both Mr. Kociscak and the Meltkveld Trust will be pat of <br />the plat. <br /> <br />Mr. Hughes explained that the whole title was transferred to Mr. Kociscak hoping the issue <br />would be resolved by now, but it has not been resolved.
