SECTION THIRTY-SIX <br />PARTIES BOUND <br /> <br /> The covenants and conditions contained in this lease agreement shall, subject to the <br />provisions as to assignment, transfer, and subletting, apply to and bind the heirs, successors, <br />executors, administrators, and assigns of all of the parties to the lease agreement. All of the parties <br />shall be jointly and severally liable under this lease agreement. <br /> <br />SECTION THIRTY-SEVEN <br />TIME OF THE ESSENCE <br /> <br /> Time is of the essence of this lease agreement, and of each and every covenant, term, <br />condition, and provision of this lease agreement. <br /> <br />SECTION THIRTY-EIGHT <br />SECTION CAPTIONS <br /> <br /> The captions appearing under the section number designations of this lease agreement are <br />for convenience only and are not a part of this lease agreement and do not in any way limit or <br />amplify the terms and provisions of this lease agreement. <br /> <br />SECTION THIRTY-NINE <br />GOVERNING LAW <br /> <br /> It is agreed that this lease agreement shall be governed by, construed, and enforced in <br />accordance with the laws of the State of Minnesota. <br /> <br />SECTION FORTY <br />ENTIRE AGREEMENT <br /> <br /> This lease agreement shall constitute the entire agreement between the parties. Any prior <br />understanding or representation of any kind preceding the date of this lease agreement shall not be <br />binding on either party except to the extent incorporated in this agreement. <br /> <br />SECTION FORTY-ONE <br />MODIFICATION OF AGREEMENT <br /> <br /> Any modification of this lease agreement or additional obligation assumed by either party in <br />connection with this lease agreement shall be binding only if evidenced in a writing signed by each <br />party or an authorized representative of each party. <br /> <br />SECTION FORTY-TWO <br />ADDITIONAL DOCUMENTS <br /> <br /> The parties agree to execute whatever papers and documents may be necessary to effectuate <br />the terms of this lease agreement. <br /> <br />16 <br /> <br />-237- <br /> <br /> <br />
