City Attorney Goodrich stated this was true but it was in the minutes that this project application <br />was extended and Mr. Kurak asked for a 60-day extension and a findings of fact is incorporated <br />in the resolution. <br /> <br />Councilmember Hendriksen asked if City Attorney Goodrich was comfortable with these <br />findings. <br /> <br />Mr. Goodrich stated he wanted to change some of the wording. <br /> <br />Councihnember Anderson asked Councilmember Hendriksen if there was a reason not to allow <br />this to move forward. <br /> <br />Councilmember Hendriksen stated he thought he heard that at least one member of the Kurak <br />family felt they had been treated unfairly in this process and he thought they should not be <br />disadvantaged. He stated he researched this and has found several problems during the process <br />and he thought they should discuss this and vote on the request. <br /> <br />Councilmember Anderson stated she did not understand why the Council needed to jump into the <br />middle of the process that seemed to be working. <br /> <br />Councilmember Zimmerman asked why they applied for rezoning. <br /> <br />City Attorney Goodrich stated they did not apply for a rezoning, they applied to have the <br />property classified from low density to low and medium density in the Comprehensive Plan and <br />no rezoning applications are pending that he is aware of. <br /> <br />Councilmember Hendriksen asked if City Attorney Goodrich could explain this further. <br /> <br />City Attorney Goodrich read a letter from Mr. Kurak. He stated they treated this as a written <br />request. <br /> <br />Councilmember Zimmerman asked if Mr. Kurak wanted mixed use or medium density. <br /> <br />City Attorney Goodrich stated this was on the lower property and Mr. Kurak was asking for a <br />low density land use for a distance of 300 feet. A transition area from the adjacent single-family <br />property and the balance of the property would be medium density. <br /> <br />Councilmember Zimmerman asked what the land was zoned now around Sunfish Lake. <br /> <br />Community Development Director Frolik stated it was R-1 Residential. <br /> <br />Councilmember Zimmerman stated if Mr. Kurak wanted low and medium density in areas, it was <br />an increased density request. <br /> <br />City Council/June 25, 2002 <br /> Page 5 of 34 <br /> <br />2O <br /> <br /> <br />
