CC Regular Session <br />Date: 11/23/2010 <br />By: Amber Miller <br />Community Development <br />Information <br />Item #: 6. 2. <br />Title: <br />Public Hearing for request for Vacation of Utility and Drainage Easements in Pine Shadows Subdivision, Outlot A <br />Background: <br />The City Council is in the process of reviewing the final plat and site plan for Alpha Development and Legacy <br />Christian Academy. The entire site encompasses what is now Pine Shadows Subdivision which has existing <br />drainage and utility easements. If left in place, the easements would run through the middle of the platted lot and <br />building location. In order to accommodate the proposed plat with the new drainage and utility easements, the <br />existing easements would need to be vacated. <br />Notification: <br />In accordance with State Statute, City Staff attempted to notify property owners within 350 feet of the subject <br />property of the public hearing to vacate easements. <br />Observations: <br />A public hearing is required to eliminate the underlying drainage and utility easements that are a part of the original <br />Pine Shadows Subdivision Plat. <br />Recommendation: <br />City Staff recommends introduction of the enclosed ordinance to vacate existing easements contingent upon the <br />approval of the Final Plat and Site Plan. <br />Council Action: <br />Motion to introduce Ordinance # 10- to vacate certain drainage and utility easements in Pine Shadows <br />Subdivision Outlot A, contingent upon the approval of the Final Plat and Site Plan. <br />Fiscal Impact <br />Budgeted Y /N: Y <br />Budgeted Year: 2010 <br />Fund: General <br />Funding: <br />Amendments to City Code are handled through normal staff duties. <br />Attachments <br />
