CC Regular Session <br />Date: 11/23/2010 <br />By: Tim Gladhill <br />Community Development <br />Title: <br />Introduce Ordinance to Amend City Code 117 -118 Relating to Front Yard Setbacks in The COR <br />A summary of the proposed changes are as follows: <br />Recommendation: <br />Staff recommends approval of the ordinance. <br />Information <br />Fiscal Impact <br />Item #: 7. 1. <br />Background: <br />The intent of The COR zoning district is to foster a pedestrian friendly, transit oriented development by employing <br />distinctly different standards than other zoning districts within the City. One of the most unique characteristics is a <br />build -to line, setting buildings close to the street. The City has received feedback on numerous occasions regarding <br />the setback requirements in the TC -1 sub - district and its relation to sidewalk requirements. In order to achieve full <br />sidewalk width, sidewalks are required to be partially constructed on private property, thus impacting the amount of <br />separation from the street that can be accommodated. <br />Throughout the life of the standards set forth for The COR, various minor amendments have been processed to bulk <br />standards and intent of this zoning district. A previous ordinance amended the front yard setback in the TC -4a <br />sub - district from 20 feet maximum to 25 feet maximum. A subsequent ordinance inadvertently reverted back to the <br />20 foot setback. Current development proposals and building permits are reviewed at the 25 foot standard. <br />1) Front yard setback in the TC -4 amended from 20 foot max to 25 foot max <br />2) Allows setbacks to be measured from edge of sidewalk easement for properties required to have a portion of a <br />public sidewalk on private property to allow for separation from edge of sidewalk in the TC -1 sub - district. <br />Notification: <br />In accordance with State Statute, a public hearing notice was published in the Anoka County Union for the Public <br />Hearing held at the November Planning Commission Meeting. <br />Council Action: <br />Motion to introduce an ordinance to revise Chapter 117 -118 of the City's Zoning Code to update front yard setbacks <br />in The COR. <br />Budgeted Y /N: Y <br />Budgeted Year: 2010 <br />Fund: General <br />Funding: <br />All costs associated with processing the ordinance are being handled as regular staff duties from the Community <br />Development Fund. <br />
