App. 50, 2010 WL 3545926 (2010) <br />COI4INECTICUT (09/21/10)—This case involved analysis of wheth- <br />er a zoning ordinance was mandatory or directory, and thus whether <br />failure to file a report in accordance with the ordinance rendered the <br />agency's decision invalid. <br />The .Background/Facts: In September 2006, Ed Zimmerman filed <br />with the town's inland.wetlands agency (the "Agency") an application <br />for the approval of two regulated activity permits in connection with <br />a proposed residential subdivision. Zimmerman sought to construct a <br />cul-de-sac and a driveway, both of which would impact wetlands. <br />The Agency eventually approved Zimmerman's two regulated activ- <br />ity permits, with conditions.
