Zoning Bulletin October 25, 2010 1 Volume 41 No. 20
in accordance with the procedures set forth in the zoning
code ... a reviewing court should not reserve the grant of
such an exception on the sole basis that some of the items
described in the plan may be completed at a later date."
Here, the court found that it could not be discerned from the re-
cord evidence that T-Mobile could satisfy the setback requirements
in the Code by moving its cell tower within its existing leasehold
with Bedford. Humble suggests new, related zoning regu-
lations be adopted by March.
Source: Arizona Daily Sun: www.azdailvsun.com
KENTUCKY
The Louisville Planning Commission recently approved zoning
guidelines for homeless shelters. Previously, the city's zoning laws "nei-
ther prohibited nor allowed a shelter to be built downtown." The new
zoning regulations now "define zoning for three types of buildings that
serve the homeless, and would allow shelters downtown." The new
zoning regulations are pending the final approval of the Metro Council
and "other legislative bodies."
Source: WFFL; www.wfoLory
MARYLAND
The Howard County Council recently voted to withdraw legislation
that would have created zoning regulations to allow wineries in Howard
County. The withdrawn legislation would have permitted larger wineries
to host up to 500 people up to 15 times per year. Reportedly, the legisla-
tion was withdrawn because of a failure to craft amendments aimed at
easing "critics' fears about large social events at rural wineries and satisfy
© 2010 Thomson Reuters 11
65
