Board Member <br />introduced the following resolution and moved for its adoption: <br />RESOLUTION 910 <br />RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO ENCROACH TEN <br />FEET INTO. THE REAR YARD SETBACK AND DECLARING TERMS OF SAME <br />WHEREAS, Dale and Sharon Grundberg, hereinafter referred .to as "Applicants," have <br />properly applied for a Board of Adjustment variance from Section 117-111 of the Ramsey City <br />Code to allow for the existing porch to encroach ten feet into the rear yard setback on the <br />properly located at 5971 143`d Circle and legally described as follows: <br />Lot 7, Block 1, Chestnut Hill, Anoka County, Minnesota <br />("Subject Property"). <br />AND WHEREAS, the Board of Adjustment conducted a public hearing on November 4, <br />2010, pursuant to Section 117-53 of the Ramsey City Code. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That based on Findings of Fact # a variance to encroach 10 feet into the 30 -foot rear <br />yard setback on the Subject Property is hereby granted. <br />2. That the porch shall maintain a 20 -foot setback from the rear property line. <br />3. That the Permittees shall obtain all the necessary permits for the enclosure prior to <br />commencing any construction on the screened in porch including, but not limited to, a City <br />issued Building Permit. <br />4. That the property owner shall be responsible for all costs incurred in administering and <br />enforcing this variance. <br />5. That this Variance shall automatically expire if the use is not initiated by November 4, 2011 <br />and issuance of the building permit shall constitute initiation. <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />and upon vote being taken thereon, the following voted in favor thereof. <br />and the following voted against the same: <br />None <br />and the following abstained: <br />None <br />and the following were absent: <br />15 <br />
