:1 I I I I I I I I I I I I I I I SECTION IV PARK DEDICATION 18. Land and Cash Contribution. The Plat is located in the Oak Recreation District. Park dedication requirements shall be satisfied by a cash payment in the amount of Ninety Eight Thousand Six Hundred Dollars ($98,600.00) (58 lots x $1,700.00/unit). This payment shall be made to the City prior to the release of the Final Plat for recording. SECTION V TRANSPORTATION AND LANDSCAPING 19. Trail Development And Fees. The City Council has enacted a trail development fee in the amount of Four Hundred Dollars and no cents ($400.00) per unit. Therefore, a payment in the amount of Twenty Three Th6usand Two Hundred Dollars (:$23,200,00) (58 lots x $400/lot) shall be paid to the CITY prior to releasing the Plat for recording. The DEVELOPER shall also be responsible for constructing an eight (8) foot wide bituminous trail parallel to Alpine Drive N.W. and Fluorine St. NW as referenced in the Grading Plan, Revised June 11, 2002. and shall provide the CITY with an easement for trail purposes. The costs associated with this trail construction are not eligible as a credit towards the Trail Development Fees and/or Park Dedication requirements due on the Plat. 20. Sidewalk Construction. The DEVELOPER shall construct and pave, in accordance with CITY standards, a five (5) foot wide concrete sidewalk with pedestrian ramps in locations . prescribed by the CITY, not to exceed 5% in grade, along the east side of Germanium Street N.W. The costs associated with sidewalk construction are not eligible as a credit towards the Trail Development Fees and/or Park Dedication requirements due on the Plat. 21. Tree, Shrub and Sod Planting Plan. The addition of trees, shrubs and sod to the Plat shall be in accordance with the approved Landscape Plan referenced in the Site Plan Development Permit. The DEVELOPER is required to submit a Plan for CITY approval that identifies existing tree growth within the Plat that will be protected during construction. The trees to be protected must be identified on the grading plan, and the plan must require the installation of 'tree save fences' prior to land clearing or grading. In addition, the requirement for this Plan shall be fulfilled by the DEVELOPER as follows: a) Minimizing the impact of construction on trees in accordance with Minnesota Extension Service publication "Protecting Trees From Construction Damage" (Publication #NR-FO-6135~S). 22. Tree Disease Prevention and Disposal. The DEVELOPER shall prevent the introduction and spread of tree disease into the residual tree populations of the Plat and adjoining properties as well as mitigate the effects of construction activity on tree health, within and Evergreen Point Subdivision Development Agreement Page7 of 12 -105-
