Land and Cash Contribution. The Plat is located in the Oak Recreation District. Park <br /> dedication requirements shall be satisfied by a cash payment in the amount of Ninety Eight <br /> Thousand Six Hundred Dollars ($98,600.00) (58 lots x $1,700.00/unit). This payment shall be <br /> made to the City prior to the release of the Final Plat for recording. <br /> <br /> SECTION V <br />TRANSPORTATION AND LANDSCAPING <br /> <br />19. <br /> <br />Trail Development And Fees. The City Council has enacted a trail development fee in the <br />amount of Four Hundred Dollars and no cents ($400.00) per unit. Therefore, a payment in the <br />amount of Twenty Three Th6usand Two Hundred Dollars (:$23,200,00) (58 lots x $400/lot) <br />shall be paid to the CITY prior to releasing the Plat for recording. The DEVELOPER shall <br />also be responsible for constructing an eight (8) foot wide bituminous trail parallel to Alpine <br />Drive N.W. and Fluorine St. NW as referenced in the Grading Plan, Revised June 11, 2002. <br />and shall provide the CITY with an easement for trail purposes. The costs associated with this <br />trail construction are not eligible as a credit towards the Trail Development Fees and/or Park <br />Dedication requirements due on the Plat. <br /> <br />20. Sidewalk Construction. The DEVELOPER shall construct and pave, in accordance with <br /> CITY standards, a five (5) foot wide concrete sidewalk with pedestrian ramps in locations <br /> . prescribed by the CITY, not to exceed 5% in grade, along the east side of Germanium Street <br /> N.W. The costs associated with sidewalk construction are not eligible as a credit towards the <br /> Trail Development Fees and/or Park Dedication requirements due on the Plat. <br /> <br />21. <br /> <br />Tree, Shrub and Sod Planting Plan. The addition of trees, shrubs and sod to the Plat shall <br />be in accordance with the approved Landscape Plan referenced in the Site Plan Development <br />Permit. The DEVELOPER is required to submit a Plan for CITY approval that identifies <br />existing tree growth within the Plat that will be protected during construction. The trees to <br />be protected must be identified on the grading plan, and the plan must require the installation <br />of 'tree save fences' prior to land clearing or grading. In addition, the requirement for this <br />Plan shall be fulfilled by the DEVELOPER as follows: <br /> <br />a) <br /> <br />Minimizing the impact of construction on trees in accordance with Minnesota <br />Extension Service publication "Protecting Trees From Construction Damage" <br />(Publication #NR-FO-6135~S). <br /> <br />22. Tree Disease Prevention and Disposal. The DEVELOPER shall prevent the introduction <br /> and spread of tree disease into the residual tree populations of the Plat and adjoining <br /> properties as well as mitigate the effects of construction activity on tree health, within and <br /> <br />Evergreen Point Subdivision <br />Development Agreement <br />Page7 of 12 <br /> <br />-105- <br /> <br /> <br />
