I <br />I <br /> <br />I <br />I <br />I <br />I <br /> <br />I <br /> <br />ADOPT ORDINANCES TO CORRECT A 1997 EASEMENT VACATION <br />IN RIVER'S BEND <br /> By: Community Development Director Sylvia Frolik <br /> <br />CASE <br /> <br />Background: <br /> <br />On July 9, 2002, the City Council introduced ordinances to correct an error in a 1997 easement <br />vacation case for Lot 45, Block 6, River's Bend. The 1997 ordinance had a typographical error <br />which resulted in the easement vacation being recorded against Lot 46 in River's Bend. The <br />Council introduced one ordinance to repeal the 1997 ordinance and a second ordinance to <br />correctly apply the easement vacation to Lot 45. <br /> <br />Observations: <br /> <br />In accordance with the City Charter, both ordinances are now eligible for adoption. <br /> <br />Recommendation: <br /> <br />City Staff recommends adoption of the enclosed ordinances. <br /> <br />Council Action: <br /> <br />Motion to adopt Ordinance #02- <br /> <br /> Roll call vote: <br /> <br />__ to repeal Ordinance #97-17. <br /> <br />Councilmember Hendriksen <br />Councilmember Anderson <br />Councilmember Kurak <br />Councilrnember Zimmerman <br />Mayor Gamec <br /> <br />Motion to adopt Ordinance #02- <br />Lot 45, Block 6, River's Bend. <br /> <br />to vacate a portion of the drainage and utility easement on <br /> <br />Roll call vote: <br /> <br />Councilmember Anderson <br />Councilmember Kurak <br />Councilmember Zimmerman <br />Councilmember Hendriksen <br />Mayor Gamec <br /> <br />Review Checklist: <br />City Attorney <br /> <br />CC: 07/23/02 <br /> <br />-185- <br /> <br /> <br />
