In addition, the DEVELOPER grants the CITY a license to enter on each lot of <br />the Plat in order to install the improvement described in this paragraph if the same has not <br />been previously constructed. <br /> <br />Street Cleaning. After the street surfacing is installed, the DEVELOPER shall clear any <br />soil, earth, or debris from the streets within the Plat resulting from any construction within <br />the Plat by the DEVELOPER or its successors and assigns. From time to time, the CITY <br />may remove accumulations of soil, earth and debris from the streets resulting from the <br />construction of the Plat. It shall be the DEVELOPER'S responsibility to pay the costs <br />associated with this necessary street cleaning. Invoices from the CITY to the <br />DEVELOPER for such costs shall be paid within fifteen (15) days of the date of invoice. <br /> <br /> SECTION III <br />PERMITS AND OCCUPANCY <br /> <br />Requirements for Building and Occupancy Permits. No building permit for any lot in the <br />Plat shall be issued until: (a) a Class 5 driving surface is installed to within 300 feet of the <br />structure; (b) a Certificate of Survey, including that survey information required by the <br />CITY has been supplied to the City Building Official, including verification that the building <br />elevation are at least two (2) feet above the 100 year flood elevation; (c) all the financial <br />guarantees required by the CITY have been satisfied; and (d) the City has been provided <br />with a copy of the Lower Rum River Water Management Permit. The CITY reserves the <br />right to suspend all building activities upon the CITY being notified by an outside agency <br />that the appropriate permit(s) was not obtain from the applicable 'agency. Approval of the <br />building foundation requires a certificate of elevation signed by a licensed (State of <br />Minnesota), professional land surveyor, verifying that the elevation complies with the <br />approved grading plan for the Plat. No occupancy permit for any lot in the Plat shall be <br />issued until: (a) vehicular access to the lot is provided including the installation of at least <br />one layer of bituminous surfacing; (b) ail u~ilities are in place, operational and accepted by <br />the CITY; and (c) boulevard sod and landscape tree, or escrow for same, have been provided; <br />(d) for lots that have a slope of less than 2%, a certificate of grading, prepared by a licensed <br />(State of Minnesota), professional land surveyor, must be provided to the City documenting <br />that the flattest grade on the lot is 1% or greater. <br /> <br />Lot Development Restrictions. The DEVELOPER herein agrees to establish and record at <br />the office of the Anoka County Registrar, a covenants or deed restriction that will impose a <br />no-build zone for primary structures on Lots 14 through 28 of Block 2. The extent of the no- <br />build zone shall comply with the Primary Structure Restriction Area prepared by Westwood <br />Professional Services, Inc., dated September 10, 2001, attached hereto as Exhibit A. The <br />purpose of this no-build zone is to buffer the existing large lots to the east from the urban <br />densities allowed in the development of the Plat. Removal of any vegetation greater than 2 <br />inches dbh (diameter at breast height) in the primary structure restriction area will be <br />prohibited unless permission is given by the City Engineer.
