The area to be developed as The Ponds Second Addition is <br />shown as Outlot B of The Ponds final plat and has been referred to previously as the "peninsula." <br />The following items are enclosed for Council review: <br /> <br />a) Site location map <br />b) Proposed final plat <br />c) Biological Review Letter from Pro Source Technologies dated May 6, 2002 <br />d) City Council Minutes dated February I2, 2002 <br />e) City Council Minutes dated May 14, 2002 <br />f) City Code Environmental Section 9.21.05(2)c <br />g) City StaffReview Letter dated June 21, 2002 <br />h) Proposed development agreement <br />i) Proposed resolution for final plat approval <br /> <br />Notification: <br /> <br />No public hearing is required at the final plat stage ora subdivision. <br /> <br />Observations: <br /> <br />The Ponds Second Addition (the "Plat") consists of seven single family lots located on 145t~ <br />Court. These lots were previously reviewed as part of The Ponds preliminary plat and received <br />preliminary plat approval on February 12, 2002. The Plat received a variance from the Board of <br />Adjustment on June 6, 2002 to exceed the 600-foot cul-de-sac restriction in City Code. 145th <br />Court is currently 600 feet in length. The Plat will extend the 145th Court an additional 180 feet. <br /> <br />The developer will be paying $11,900 in park dedication fees and $2,800 in trail dedication fees. <br />In addition, Royal Oaks Realty will be paying $12,698 in sewer and water trunk fees and $2,625 <br />in stormwater management fees. <br /> <br />Preliminary Plat approval for the Plat was contingent upon the completion of a biological survey <br />to determine the existence of any Blanding's Turtles or their habitat on the development property. <br />The survey was conducted in April by Pro Source Technologies and the City received a letter on <br />May 8, 2002 that no habitat or actual Blanding's Turtles were found on the site. <br /> <br />At your May 14, 2002 meeting, the Council approved the final plat of The Ponds subdivision, <br />which consisted of 79 single family lots, 88 townhome units, one large lot for a future apartment <br />building and Outlots A and B. At that meeting a motion was made and approved to prohibit the <br />removal of any trees on the "peninsula" (the Plat) until a tree preservation ordinance is in place. <br />That motion provides specifically as follows: <br /> <br /> <br />
