Motion by Councilmember Kurak, seconded by Coundlmember Anderson, to adopt Ordinance <br />#02-05- . . rezoning property contained in the proposed plat of The Ponds from B-1 Business <br />and R-1 Single Family Residential to R-1 Single Family Residential, R-3U Residential, and <br />Multiple Residential. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Councilmember Anderson aye <br />Councilmember Kurak aye <br />Councilmember Zimmerman nay <br />Councilmember Hendriksen nay <br />Mayor Gamec aye <br /> <br />Motion carried. <br /> <br />Case #3: Request for Final Plat Approval of The Ponds; Case of Royal Oaks Realty <br /> <br />Principal Planner Trudgeon stated that on February 12, 2002, ROyal Oaks Realty received <br />preliminary plat approval for the subdivision of their property generally located along Nowthen <br />Blvd. (CSAH 5) and Dysprosium St. The property is approximately .86.71 acres in size and the <br />approved preliminary plat consisted of 86 single family lots and 91 townhome units. Royal Oaks <br />Realty will be submitting two final plats for consideration; The Ponds and The Ponds 2"a <br />Addition. The Ponds final plat consists of 79 single-family lots and 91 townhome lots, as well as <br />a large lot for a future apartment building. The Ponds 2"a Addition consists of 7 single-family lots <br />located on the peninsula of 145t~ Court and will be considered at a later date. The Ponds final plat <br />shows 79 single family lots, 91 townhome lots, and one 4.41 acre lot (Lot 1, Block 9) for future <br />development of an apartment building. Lot 1, Block 9 will not be allowed to be developed until <br />the City grants site plan approval of an apartment building. In addition, The Ponds final plat <br />shows two outlots, Outlot A, a small parcel on the north side of Nowthen Blvd. that will be <br />deeded to Lord of Life; and Outlot B, which will be final platted as The Ponds 2~d Addition. In <br />accordance with the approved preliminary plat, ROyal Oaks Realty has removed two single-family <br />lots backing up to the existing trail easement. The grading, drainage, and utility plans have been <br />reviewed by the City Engineer and comments and corrections regarding those plans have been <br />sent to the developer in a letter dated May 6, 2002. The developer is being charged a sewer and <br />water development fee of $306,380 (170 x $1,814.00/per unit) that will be paid prior to releasing <br />the final plat for recording. There is also a stormwater management fee of $63,750 (170 lots x <br />$375.00 per unit) that will also be due prior to releasing the final plat on recording. The utility <br />fees for the lot of the future apartment building will be charged at time of site plan approval. As a <br />result of several meetings with the Park Commission, the developer will be dedicating 4.8 acres of <br />upland as parkland and will be paying an additional $106,930 to satisfy park dedication <br />requirements. The developer will also receive credit for 2,870 lineal feet of trails that they will be <br />constructing as part of the development and will pay $27,820 to satisfy the remaining portion of <br />the required trail dedication fees. Preliminary Plat approval was contingent upon the developer <br />removing two single family lots backing up to the existing trail.
