-292- <br /> <br />That the City Code allows for a total of 1,488 square feet of garage and accessory buildings <br />on the Subject Property; there is an existing 440 square foot garage; a I92 square foot storge <br />shed; the proposed garage will be 780 square feet; this totals 1,412 square feet, which is in <br />compliance with City Code. <br /> <br />That the City Council adopted an ordinance to amend the P,-I Residential District and <br />effective July 11, 2002, the side yard setback on comer lots in the Rural Development <br />District will be 40 feet. <br /> <br />'10. That on June 6, 2002, the Board of Adjustment adopted Findings of Fact and denied the <br /> Applicant's request for a variance based on failure to prove a hardship. <br /> <br />11. That on June 1 ?, 2002, the Applicant submitted a written request for an appeal to the decision <br /> of the Board of Adjustment. <br /> <br />12. That the special conditions do/do not result from the actions of the Applicants. <br /> <br />13. That the variance requested is/is not-the minimum variance that would alleviate the hardship. <br /> <br />14. That if granted, the variance will/will not permit a use that is prohibited in the R-1 <br /> Residential District. <br /> <br />15. That if granted, the variance will/will not impair an adequate supply of light and air to <br /> adjacent property. <br /> <br />16. That if granted, the variance will/will not unreasonably increase the congestion in the public <br /> street. <br /> <br />17. That if granted, the variance will/will not increase the danger of fn'e or endanger the public <br /> safety. <br /> <br />18. That if granted, the variance will/will not unreasonably diminish property valueS in the <br /> neighborhood. <br /> <br />19. That if granted, the variance will/will not violate the intent of the Comprehensive Plan. <br /> <br />20.
