The subject property consists of 63 acres of which the proposed activity would be
confined to 9 acres.

The City Council originally approved a conditional use permit for grading and exporting of soil
from this property on March 25, 1997. The applicant did not initiate the conditional use permit
within this three-year timeframe. The applicant subsequently applied for and received a new
conditional use permit to mine material on May 23, 2000, wltich was to expire two years from the
date of commencement of the operation, but no later than three years from the date of issuance.
Material was mined for the T.H. 47 project in June 2000, and for additional uses thereafter. The
applicant desires to continue the mining and grading operation to completion of the original
proposal of nine acres; and has reapplied for a continuation of the mining and grading conditional
use permit.

The following items are enclosed for your information:

a)
b)
c)
d)
e)
f)
g)
h)
i)
J)
k)

Site location map
Letter dated January 14, 1997 describing operations and intentions
Narrative for Borrow Pit utilization
Grading Plan revised April 22, 2002
Planning Commission meeting minutes dated February 4, 1997
City Council meeting minutes dated March 25, 1997
Planning Commission meeting minutes dated May 2, 2000
City Council meeting minutes dated May 23, 2000
Planning Commission meeting minutes dated June 6, 2002
Proposed Findings of Fact
Proposed Conditional Use Permit

Notification:

A public hearing was held by the Planning Commission on June 6, 2002.
