I I I I I I I I I I I I I i I I I I Councilmember adoption. introduced the following resolution and moved for its RESOLUTION #02-06-XXX RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY FOR ACCESS TO ELMCREST PARK WHEREAS, the City of Ramsey has acquired 95 acres of land in the northern half of section 14, west of TH 47, for the development of a community park known as Elmcrest Park; and WHEREAS, the development standards for a community park requires access to an arterial, or collector roadway, such as TH 47; and WHEREAS, the TH 47 Access and Corridor Study which was adopted by the City Council identifies the location of 164th Lane as the only permissible access point to the TH 47, which is feasible to provide access to Elmcrest Park; and WHEREAS, the City has the authority to acquire real property for Public Improvements by eminent domain pursuant to Minnesota Statutes Chapter 117 and pursuant to City Charter; and WHEREAS, the City has the fight to acquire the real property prior to the filing of an award by the Court appointed commissioners, pursuant to Minnesota Statutes 117.01 l and 117.042; and WHEREAS, the real property which needs to be acquired to provide reasonable access to Elmcrest Park is legally described as follows: See attached Exhibit "A" WHEREAS, the property owner of the real property which needs to be acquired has been identified by the City as follows: See attached Exhibit "A" NOW THEREFORE, BE IT RESOLVED BY THeE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the City Administrator is hereby directed to acquire the real property as described above in accordance with Minnesota Statutes. The City Administrator is authorized to negotiate and represent the City of Ramsey in all proceedings. That if the real property as described above cannot be acquired by direct negotiation, it shall be acquired by eminent domain. 02-06-XXX -349-
