I <br />I <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Police Sergeant Way reviewed that during a Council Work Session of May 21, 2002, he <br />presented information regarding proposed changes to the Public Nuisance Ordinance. Staff has <br />made the revisions to the ordinance that were discussed that evening and a copy of that <br />preliminary draft has been provided to the Council. <br /> <br />City Attorney Goodrich stated that prior to final adoption he will rearrange the sections but <br />believes the language is appropriate. <br /> <br />Councilmember Anderson noted there are many ponds in Rarnsey and questioned if that <br />reference should be removed from the ordinance. <br /> <br />Councilmember Hendriksen noted that there are many areas that, in August, will become <br />stagnant pools of water. <br /> <br />City Attorney Goodrich stated if it became a problem, the language in Subdivision 1 could be <br />applied. He stated the entire subdivision 2, c, "ali ponds or pools of stagnant water" could be <br />removed without causing harm to the public. <br /> <br />Mayor Gamec asked how the decibel level is determined. <br /> <br />Police Sergeant Way stated it would require the City to purchase equipment to measure the <br />decibel level and then it must consider the area the noise should be measured fi.om. <br /> <br />Joseph Roberts, Jr., 18020 Uranium Street NW, stated he did not move to Ramsey to live across <br />from a race track but the issues he has had with neighbors over the last nine years has to do with <br />abuse of vehicles and loose hounds. He advised of a party held next door to his house where <br />they ran three motor cross vehicles all day on a track. He stated that party lasted for two days. <br />Mr. Roberts stated that use occurred again last week so he spoke to his neighbor who indicated it <br />was a legal use. He stated if this was a once a year event, he does not th/nk anyone in the <br />neighborhood would have .an issue. However, to disrupt peace of mind, peace of existence, and <br />use of his property, and then not have the courtesy to negotiate it, is a concern to him. Mr. <br />Roberts stated his support of this ordinance. <br /> <br />Mayor Gamec asked Mr. Roberts if he or his wife had called him about this issue. <br /> <br />Mr. Roberts stated that either he or his wife have spoken with all on the Council except <br />Councilmember Hendriksen. <br /> <br />Motion by Councilmember Kurak, seconded by Councihnember Anderson, to approve the <br />introduction of an Ordinance to amend Section 5.08 of City Code which section is entitled <br />"Public Nuisance" as revised to strike Subdivision 2, c. <br /> <br />Further discussion: Councilmember Hendriksen noted Subdivision 2, e, and pointed out that the <br />City already has an ordinance that addresses the accumulation of manure.
